The Shawnee County Sheriff's Department arrested a Colorado man Friday morning in Wabaunsee County and seized more than $23,000 in cash, authorities said.Sheriff's Capt. Rick Hladky wouldn't release the name of the man in custody, 26, whom he said had been driving alone.
The arrest was made by a member of the sheriff's department's drug interdiction unit, which has permission from several surrounding counties to try to catch people who transport illegal drugs in those counties.Hladky said a member of the interdiction unit stopped a vehicle for a traffic violation at about 10:46 a.m. on Interstate 70, about six miles east of the highway's Maple Hill exit."The odor of burnt marijuana emanated from the vehicle," he said.Hladky said the deputy searched the vehicle and seized a small amount of marijuana and drug paraphernalia, as well as $23,620 in cash.Authorities suspect the driver had delivered 25 pounds of marijuana in Topeka and was taking the proceeds to Colorado, Hladky said. The man was arrested in connection with possession of marijuana and possession of drug paraphernalia, both misdemeanors, Hladky said.He said Shawnee and Wabaunsee county officials have agreed to each take a percentage of any money seized by the Shawnee County interdiction unit in Wabaunsee County.Kansas forfeiture laws empower authorities to confiscate property, including money, linked to illegal activities. Once property has been seized, prosecutors must file a civil proceeding saying why it should be forfeited. If the owner doesn't respond, the property is forfeited. If the owner fights the seizure, authorities must present "clear and convincing" evidence in court that the property is linked to illegal activities.Pubdate: September 18, 1999Copyright 1999 The Topeka Capital-Journal Forfeiture Endangers American Rights Foundationhttp://www.fear.org/
