Medical Marijuana Law Misunderstood

Vermont -- Most Vermonters appear to not know that we do not have a “medical marijuana” law in Vermont. You cannot get a “prescription” for marijuana here. Regardless of any illness, it is not legal for a citizen to possess marijuana in Vermont. The term “medical marijuana” cannot be found in our statutes.It has become a generic term for identifying states that have a specific law addressing the compassionate use of marijuana. However, our Legislature had an intentionally different approach in combining compassion with a respect for federal law and mixed scientific evidence.
Science confirms that some individuals find symptom relief they cannot find in traditional, legal drugs with certain specific medical conditions. The Food and Drug Administration has not concluded, however, that benefits outweigh health risks. Vermont, therefore, explicitly chose to not use the term “medical.” Its term is “use of marijuana for symptom relief.”Vermont also chose to not place physicians in the position of writing prescriptions for marijuana, which could place them in legal jeopardy. Instead, a physician only verifies that a patient has one of the specifically listed illnesses or conditions, and it has not responded to other treatment.That verification is submitted to the Department of Public Safety to receive an identification card that proves the individual is on the registry. Choosing the Department of Public Safety, not the Department of Health, as registry coordinator created reassurance for law enforcement that the process would be taken seriously.
