Los Angeles, CA -- Medical marijuana users and dispensary owners in California have held their breath for years - fearful they would be targeted for prosecution by the federal government.They finally exhaled this past week when U.S. Attorney General Eric Holder said federal agents will now target marijuana distributors only when they violate both federal and state laws, a departure from the policy of the Bush administration.
It's not seen by man as a move by the Obama administration toward the legalization of marijuana. However, it could end much of the confusion among state and federal authorities dealing with the mishmash of laws in which cultivating, using and selling pot for medical purposes is allowed by states but outlawed by the federal government."This signals, in my mind, a true kind of federalism," said Jody Armour, a law professor at the University of Southern California. "The federal government is allowing states to take chances, to take experiments and see what happens."California is one of 13 states that allows medical use of marijuana.Over the past 3 1/2 years, the federal Drug Enforcement Administration has raided about 75 dispensaries in just one of the four federal districts in California, the Central District that extends from the Central Coast to down to Orange County and includes Los Angeles.Yet criminal charges have only been filed in several of those cases against the biggest distributors accused of breaking both federal and state laws, said Thom Mrozek, spokesman for the U.S. attorney's office in the Central District of California."What we have done in all of our narcotic cases is to focus on large-scale traffickers," Mrozek said. "In terms of what happens in the future, the federal government will continue to enforce federal narcotics law."The confusion was reflected in a case against Charles Lynch, who ran a marijuana dispensary in Morro Bay. Federal prosecutors said he should have known his employees sold marijuana outside his store.Lynch, 47, was convicted in August of distributing more than 100 kilograms of marijuana. His sentencing is set for Monday; guidelines allow up to 85 years but prosecutors recommended a five-year prison sentence.Lynch's attorneys will try to persuade Department of Justice officials to drop the case."The feds picked the wrong guy," federal public defender Reuven Cohen said. "It's pure fiction that somehow Charlie was not in compliance with state law."Two of the jurors who convicted Lynch also took issue with the federal prosecution. They wrote letters to U.S. District Judge George Wu asking for leniency, saying they felt they were forced to find him guilty under federal guidelines."Because of the instructions we were given regarding that we were to disregard state law, I felt we had no other option but to convict Mr. Lynch," juror Andy Gordon wrote.Fellow panelist Reza Iranpour called the verdict a "miscarriage of justice" and said Lynch was a victim of "bureaucratic conflict."Lynch "faces the prospect of being severely punished for trusting misleading laws and regulations," Iranpour wrote.Medical marijuana advocates say the change in federal policy announced by Holder mirrors the spirit of the 1996 California ballot initiative that made it legal to sell the drug to people with a prescription."I think that if nothing else it gives people a sense of optimism that the federal government is going to back off," said James Shaw, director of the Union of Medical Marijuana Patients. "But it's not entirely clear to me if they are going to do that."Holder didn't specify who would be exempt from future DEA raids. And one federal prosecutor said cases will still be filed against people who violate the law by selling marijuana for non-medicinal purposes and other actions."From the type of dispensaries we have seen over the years, it may be anticipated this does not signal an end to federal enforcement actions but instead a refinement," said acting U.S. Attorney Lawrence Brown in Sacramento.Times have changed, agreed Elliot Katz, a senior member of a Los Angeles-based marijuana collective, but necessarily for the better.He recalled walking into a dispensary when he was first issued a medical marijuana card in the mid-1990s and finding that everyone was visibly sick.These days, marijuana users who have no medical reason to obtain the drug are taking advantage of the system, he said."It's up to the doctor or dispensary operator to weed out those people," said Katz, 46, who has AIDS. "The government can do all they want to regulate, but it's up to us to regulate ourselves." It's amazing and wonderful.
"We now are closer then ever and that's a darn good feeling." Finally, nearing the end the widespread persecution and destruction this matter, cannabis prohibition, has caused.It is a good feeling. It's still out of sight... but it feels closer than it has in a long, long while.And the 'enemy', those who would keep up the prohibition, is still ravenous and still among us. They still have a lot of power and they are still wanting very much to keep their prohibition policies, growing, functioning, and mean. On top of all that, they're self-righteous busy bodies and many of them, or their friends, and family members profit financially from the prohibition of cannabis.Yes... we're not there yet. But we're bigger, stronger, and louder than we've ever been.They better pay attention to those of us who would make peace. It actually could get worse and it's so bad already.

It's seems like a million miles away now. I remember when I decided to do CNews after Ron Bennett gave it to me. I thought I think I could give a year of my life to help get the law changed. I'm glad we can't see the future because if I had any idea we would still be here after all these years I don't think I would have tackled it but I'm glad I did.

All I Really Want
I want our country to get it's Good Spirit back again. I remember that Jack Herer said that he wasn't sympathetic to the Vietnam War Protesters until he smoked marijuana. Then he was able to understand. Cannabis is important because it helps people broaden their minds and it makes them more reasonable in my opinion.

Been thinking more occasionally about the years
here at C-News lately.Remember when we used to have to virtually do spiritual and mental calisthenics... vigorous jumping jacks, spiritual sit ups, sets of them, coaching each other through it, for days and weeks at a time, trying to control our anger and desire to hate, and focus it into something, hopefully, more constructive?It helped. Statistics are positive or negative in how you look at them.31% Legal7% Legal if taxed and Money used for Projects58% Illegal, even if it could be taxed.What I see here is that 38% of the people were willing on a cold call over the phone to say they think marijuana should be legal.If the survey was blind and anonomous I bet the results would be 60/40 in our favor.I wonder what the missing 4% felt.If you add them to our side you are at 58/42 against legalization.Also, remember this is legalization, not decriminalization.Then if you add the estimated possible error percentage of 3% you could be at 55/45.That is only 5% below half, on a cold call, over the phone(cell phones were included).Give us a year of an administration that is putting the emphasis on science and I bet we will be over the threshhold on the number of people who would respond favorably, even on a cold call.Maybe then, finally, cannabis will at least be equal with alcohol.

I've been wondering about him, too. I did figure he was busy with a project and hadn't had time to post... but I was about ready to knock on his email door. It's good to know he's ok.Always, I try to assume the best... and I figured if something was wrong you would have let us know. Thanks again.Sometimes we just don't have anything to say about anything. I fully understand that. I get that way, too, sometimes... believe it or not.

My very first thought when I saw that was..Something wasn’t right.5 years ago or more while reading comments from national and local publication articles the comments would be around 10 negative comments for every positive one. FoM, you must be [p]sycic!
I spent the afternoon with him yesterday. An old friend, ZuZu John, came by. We talked about C/News, the new shift in policy etc. He is real busy these days with some projects. He and his wife are doing well. His wife is a sweetheart. His youngest daughter [13] came home from school yesterday. Before I went to prison I was good friends with her. I have not seen her in about 3 years. Now, she is such a beautiful young lady! Was glad to see her. I'm truely like an uncle to his seven kids. They are all so smart and talented, and beautiful.His middle daughter is, I think, a junior at So. Oregon U.
She is being sponsored as a foreign exchange student in Mexico. Mrs. Museman has a brother in Mexico City who is a lawyer down there. He said he will be available for when she comes.All things considered he seems to be doing well.

So if I rob a Post Office, my employer could be prosectued becase they should have known I'm a Post Office robber?Since when does a jury HAVE to come up with a certain verdict? The jury was free to find him not guilty, guidelines or not!
