Medical Marijuana Advocate Ordered To Return To US

Vancouver -- After losing his last legal challenge to stay in Canada, medical marijuana advocate Steve Kubby has been told to leave the country by Thursday. A Federal Court judge rejected Kubby's last appeal to stay in the country. His wife Michele told the judge her husband would die if he had to return to California to serve out a jail sentence.
Kubby has adrenal cancer and uses marijuana to ease the symptoms.Before Kubby came to Canada he was convicted for having a small amount of drugs and sentenced to house arrest. Kubby and his wife now say he would have to serve his sentence in jail, and that officials at any U.S. jail wouldn't allow him to smoke his marijuana. Kubby, a former ski magazine publisher, lost his legal bid last week to stop his deportation by Immigration Canada. The family moved to B.C. in 2001, settling in Sun Peaks Resort after living in Sechelt. Immigration Canada ordered them out by Jan. 12, but that deadline came and went while the Federal Court judge made his decision. While he has been ordered to leave, Kubby said he is still fighting to stay in the country through the courts. "The immigration ministry claims that its departure orders are not subject to appeal, but we're still trying to get a court to simply grant us our due process and allow us to appeal,'' he said in a news release on Monday. Kubby's claim for refugee status in Canada was rejected a few years ago. If Kubby is forced to return to the U.S., he said he will head back to San Francisco and try and stay out of Placer Country, where he was to serve his sentence. Michele Kubby and the couple's two daughters will be driving back to California. I have been really quiet and working on a web site I wanted to update and have been doing a lot of thinking. People that are upset about what is happening with the Kubbys have different reasons why they are upset. The crime is victimless that caused all these years of turmoil for the Kubbys. We spend so much time worrying that the children might be exposed to bad things so we chase the parents and guess what? The children that our society says it wants to protect creates a terrible situation for the CHILDREN. This punishment system is causing terrible things to happen in the minds of those that have been hurt by these laws. Someone in power needs to wake up and soon and look at this issue honestly. Thanks for reading my rant.

Hate Crimes
  My govt. makes me sick, and I am ashamed of the hate crimes they perpetrate against the most vulnerable and defenseless among us.  ANYONE who is a thinking human being can see that the Govt 
( READ,He had the cojones to stand up to the US Govt ) had a hard on for Kubby ) and the rest is history.
Here we are today, with two sovereign nation spending time and recources to punish a man who has harmed no person, nor any persons property.  I have to cry FOUL. Where is the victim!!!!  The only victim ( besides Kubby and his family, & liberty ) is the bloated salary, benefits, medical coverage, & retirement benefits if they are not succesful in putting Kubby in prison.  I could go on and On, but my outrage exceeds my typing and spelling skills.

So much for this compassionate conservative, states rights BS from the Neo-Con Puppet. If there's one thing about George W. Bush, it's he is not prejudice. He hates EVERYONE. No death row pardons the entire time he "ran" Texas. Not even for the born-again Christian lady. None. Nada. And he does not mind one iota, about killing our children in WARS FOR PROFIT, either. The Kubbys
I looked at mapquest and see it will be a long drive for Michele and the children. I hope she will have someone to drive with her that far. I want to thank all those in Canada for helping them while they were with you. Hopefully the activists down here will be able to help them now. The stress of living like they have must have been terrible. Never knowing when a knock on the door could happen. The children will miss their friends and that bothers me too. God Bless and I hope everything will work out ok.

So sad and so wrong
What they are doing to the Kubbys is so wrong. I'm sure they've paid plenty of taxes up there on the Sunshine Coast, but it doesn't matter. Someone's getting their arm twisted by the Canadian branch of the DEA to make sure Steve goes down as an example and Michelle gets to be a grieving widow with two fatherless kids. Destroy a good man in order to protect their DEAth dealing jobs. I'm incensed by their inhumanity, but certainly NOT surprised.Jah speed and strength, Steve!Shishaldin

I know this will be very hard for them but they will make it thru this. They are survivors and have strong wills. Maybe it won't be as bad as feared. That's my hope.
