Vancouver -- Medical marijuana "refugee" Steve Kubby, his wife, Michele, and their two daughters are scheduled to be deported to the United States this week unless they can delay a removal order at a Federal Court of Canada hearing this morning. The family is asking for an emergency stay of the order by Immigration Canada, arguing that Mr. Kubby's health will suffer if he is deported and has to serve a 120-day jail sentence in California without marijuana to deal with his adrenal cancer.
They have been in Canada since 2001 when Mr. Kubby was convicted of possession of a minute amount of mescaline and psilocin. Immigration Canada rejects Mr. Kubby's claim for refugee status and says there is no risk to the health of the Kamloops resident if he is deported to the United States. The deportation would be another legal defeat for medical-marijuana advocates and supporters of legalizing the possession of cannabis. Court rulings in recent years have upheld the criminal prohibitions against possession of marijuana as well as the system that is in place for people to use the drug for medical reasons. However, some people say this system is flawed and makes it difficult to acquire their medicine. Michele Kubby, who represents the family in court, remains optimistic about the last-ditch appeal. "If you never give up, you will never lose hope," said Ms. Kubby, who said her husband should not be deported for a misdemeanour. "You have to be convicted of a serious offence" to be deported, Ms. Kubby said. She said her husband has been targeted by U.S. authorities, because of his pro-marijuana profile and his run for governor of California in 1998 as leader of the Libertarian Party. "They have been keeping their eye on him for a long time," Ms. Kubby said.As part of their legal battle, Ms. Kubby challenged the validity of the Marijuana Medical Access Regulations (MMAR), the scheme that governs how people can possess marijuana for medical reasons. She contends it is constitutionally unsound. The British Columbia Court of Appeal ruled against Ms. Kubby last month and said she failed to present evidence "her own Charter rights regarding marijuana usage were likely to be infringed." The court also found support for the MMAR in an Ontario Court of Appeal ruling in 2003 that upheld the overall legislation, but struck down some of the sections as being unconstitutional. The Ontario court was critical of a section that permitted registered producers to grow marijuana for only one person. It described the MMAR rules as constituting "significant state interference with the human dignity of those who need marijuana for medical purposes." It ordered Health Canada to allow registered growers to distribute the drug to more than one person, so users did not have to rely on the black market.Health Canada repealed the section, but a few months later, it quietly re-enacted the exact same restriction on producers. An "analysis statement" issued with the new regulations referred to the court's ruling as "untenable" and said it would result in Canada violating its international treaty obligations to restrict the distribution of marijuana. The medical regulations also permit designated users to grow their own marijuana or purchase it from the federal government's supply, produced by Prairie Plant Systems in Manitoba.About 75 kilograms of marijuana was sold to medical users in 2005. "We can easily meet current demands," said Health Canada spokesman Christopher Williams. But Michelle Rainey, vice-president of the B.C. Marijuana Party, contests the belief that there is a sufficient supply for the 1,118 people in Canada who are currently authorized to possess marijuana for medical use."There is not enough, not at all," said Ms. Rainey who along with Marc Emery and Greg Williams is facing extradition to the U.S. for selling cannabis seeds on-line.Ms. Rainey, who suffers from Crohn's disease, said there are other problems with the government supply, including the quality of its marijuana. "It is like prescription drugs, not every strain works," said Ms. Rainey. She noted that the government marijuana is about $200 for 30 grams, which is "just under street prices." It took Ms. Rainey seven years to be granted an exemption for medical use. Ms. Rainey said another obstacle for those interested in using marijuana for medical purposes is the Canadian Medical Association. She said it discourages doctors from giving the necessary approval so their patients can acquire marijuana.Ruth Collins-Nakai, president of the association, said "we are not taking a pro or con position. What the CMA is opposed to, is the current MMAR because we don't have the scientific evidence about the risks or benefits [of marijuana use]," Dr. Collins-Nakai said. She said doctors who approve the use of marijuana may be at legal risk if a patient suffers complications. In addition to complaints about the procedures in place for medical marijuana users, it seems unlikely that criminal sanctions for simple possession of marijuana will be eased in the near future.Note: Kubby fighting deportation on grounds he needs marijuana for his cancer care.Source: Globe and Mail (Canada) Author: Shannon KariPublished: Monday, January 9, 2006 - Page S1Copyright: 2006 The Globe and Mail CompanyContact: letters globeandmail.caWebsite: http://www.globeandmail.com/Related Articles & Web Sites:The Kubby Chronicleshttp://www.kubby.org/The Drug War Refugeeshttp://freedomtoexhale.com/smk.htmFormer Placer Medipot Activist May Lose Refugehttp://cannabisnews.com/news/thread21451.shtmlKubby Stays Positive About Medical Pot Case http://cannabisnews.com/news/thread20692.shtml

A Tearful Plea of Desperation
By Matt Kieltyka, 24 HOURS
   Tuesday, January 10, 2006
Michele Kubby stood outside federal court in Vancouver yesterday in tears, saying all she can do is wait for a knock on the door before being forced out of the country. Kubby was in court to make the last stand for her husband, Steve Kubby, a cancer patient and medical marijuana user who is facing deportation to face a 1998 California drug conviction. She told the courtroom that if deported, Steve would be thrown in jail and wouldn't have access to the treatment he needs. "My husband is being asked to go down to the States and be an experiment to see how long he lasts without medical help," Kubby argued at one point. "Sorry to get angry, but my husband's life is on the line." Steve Kubby was to serve a three-month term under house arrest in 2001 for growing marijuana in his home, but came to Canada with his family due to more lenient drug laws. Yesterday's hearing marked the end of a long legal battle including the immigration refugee board, court of appeal and federal court. The decision, expected later this week, will determine whether Kubby will be granted leave to stay in Canada. The entire family, who reside in a rural area near Kamloops, faces deportation. Immigration lawyer Keith Reimer said there are compassionate-use laws available in California for Kubby to use marijuana and that his life would not be in danger if he was deported. Feeling hopelessness after taking her husband's defense into her own hands, Kubby asked Canadians for help and understanding. "I'm not a lawyer, I'm a wife and a mother," she cried. "I need to ask the Canadian people for help because I'm losing the battle for my husband's life. We're waiting for a knock on the door for someone to take us away."

Afterburner
Sometimes I think these last 5 years is a lifetime ago. We had a little hope and lots more confidence that right will win but now I don't know. Our government system is spinning in so many different directions and all of them serious and that boggles my mind. Corruption, control, hate, conformity and so many more thoughts go thru my mind almost all the time. Something must give because I know I am not alone in the way I feel.

Steve Kubby Is the Only One In This Story Who Has NOT Broken The Law, But He Faces the Death Penalty. Kubby Family Pleas for Public Support, As Judge Delays His Decision on Whether Cancer Patient Must Be Sent to Die in US Jail.VANCOUVER -- Canadian Federal Judge, Yvon Pinard, has “taken under advisement” the question as to whether to stay (stop) Immigration Canada’s attempt to send Steve Kubby, cancer patient and medical marijuana refugee, to die in an American jail this week. The judge said that he might decide ‘tomorrow’ or it could be ‘weeks.’Michele Kubby, who argued on behalf of her husband, said, “We are glad that the judge is at least considering the issues, but my husband is already seriously ill and the added stress of not knowing when he may rule makes things even more difficult for Steve. We need everyone’s help.”Despite a statement by Placer County California prosecutor, Chris Cattran, that Kubby would be jailed on his return to the US, and would be sentenced to at least 120 days in jail, plus penalties for probation violation, the Immigration Ministry’s counsel, Keith Reimer, argued that there was no proof that Kubby would be arrested if he is delivered to US authorities. Cattran prosecuted Kubby in 1999 after a six month surveillance of the Kubbys’ home based solely on an anonymous letter.Reimer also claimed that prisoners in US jails receive proper medical care, and can sue if they don’t get it. Mrs. Kubby pointed out that her husband needs cannabis regularly, and no US jail allows its prisoners to have cannabis. After the hearing, Mrs. Kubby spoke to a large group of journalists from the Canadian media. The Kubbys’ nine year-old daughter Brooke was also interviewed. The hearing was attended by Seattle lawyer Douglas Hiatt, who represented another American medical marijuana refugee, Steven Tuck, who was held for a week in Washington State jails without being given even antibiotics. Tuck was taken from a Vancouver ER in handcuffs last October and forcibly returned to the US.Hiatt was not allowed to testify, but he did speak to the Canadian media about the conditions in US jails and prisons. He emphasized that the rights of medical marijuana prisoners are often violated, and most prisoners do not get proper medical care.

Steve Tuck Is A Free Man. Vindicated. Recuperating from Five Year Ordeal. Will Return to Mining Business in Canada After First Of Year. Mrs. Kubby was distressed to find herself having to explain to the court that her husband’s death would clearly constitute “irreparable harm”, while the Immigration Ministry argued that not sending Kubby to the US immediately would not be “convenient” for the Ministry. From 2003, see
A Critique of the Kubby Refugee Ruling: What Is It About Dead That You Don’t Understand?
"Considering that this was a routine request to issue a temporary stay while the court considers our motion, I have lost all remaining faith in the court system and can only plead with people who hear about our situation to call, call and call again until those Ministers who are responsible fix this legal nightmare," said Mrs. Kubby. "Phone calls to the Ministers of Immigration, Health, Justice and Public Safety may be our only hope now," added Mrs. Kubby. ###Joe Volpe, Minister of Immigration, Voice: (613) 954-1064, Fax: (613) 957-2688Ujjal Dosanjh, Minister of Health, Voice: (613) 995-7052, Fax: (613) 995-2962Irwin Cotler, Minister of Justice, Voice (613) 992-4621, Fax: (613) 990-7522Anne McLellan, Minister of Public Safety, Voice (613) 991-2924, Fax: (613) 952-2240See

FoM, as for vet status I don't know?
I think Kubby was in NG or something like that but am not sure? And as far as a private plane that is extremely complicated without incurring more charges, there isn't going to be a quick fix for this problem nor any way Steve could/would survive jail long enough to get to Placer County to even try for house arrest, as that will take weeks even with his and courts consent as there are steps that must be followed each level of gov't involved. I was only lucky because after ours and others arrests in HumCo, the patients had had enough and elected a new DA who was much more realistic to us and our cause so he co-operated with my defense team at every step...as did AUSA without which I would be in a funeral home or suffering in jail like a dog in mind blowing pain!!! Kubby has Placer County DA, Caltrans to contend with and he's already shown he hates Kubby so I figure he will get some Washington sheriff/jailer to do his dirty work cause one thing Kubby has going for him is the Jailer in placer County wouldn't accept him in jail back in 2000 so he may get a break there if he can live long enough to get there. Doesn't look good at all, for Kubby or freedom in general. Peace, Steve Tuck

Another Question
Since the charges have nothing to do with marijuana and house arrest could have maybe worked is it possible he now could get house arrest if they are lenient? I worry about what this might be doing to the minds of their young children.

Oh my. I am very upset about this and when I am upset I try to make things go as easily as possible since I know as you know that many things are out of our control. So you mean that they couldn't come back to Placer County on their own if they wanted too. Right? Could a private plane return them? I might sound really uninformed because I really am.

FoM, Michelle has also been ordered out
of Canada as well which by extension would apply to the kids. What will happen (If they don't leave before 13th or Immigra doesn't snatch them as a so-called 'preventative' measure as soon as decision is announced, besides Immigra snatched Kubby's passports/ID as part of their 'inturnment' process which makes flying to Cali direct dificult at best? as they did me before time/date they gave me) is they would be driven to the border (Peace Arch, how ironic?) by Canadian Immigra and handed over to US Immigra who would then arrest Steve on warrents from Cali and take him to Whatcom County,Wa. jail which is a little shithole of a jail with a doctor that could double as Gestapo. I would assume Michelle and kids have no warrents so they could go on their own power to anywhere they so chose I guess??? I pray that something can stop this enevitable grinding process that is like bombing in which those doing the killing never have to look their victim in the eye as their sure that the killing will be well down the line from them and it's all quite so sterile of quality to every lie they speak as it's nothing personal if we are going to die or suffer as it wasn't them who did it, they think? Nazi's udes same logic to same conclusions. We have been branded 'uberhumans' and there is no atrocity which is too horrible for them to commit against us, won't be long before we all have our state cannabis permit number tattoo'ed upon us, for our own protection or course... so the police can tell who is a 'real' patient will be party line all the way to Hell. Wife of Failed U.S. Medical Marijuana Refugee Pleads to Stay in CanadaJanuary 9, 2006VANCOUVER (CP) - The wife of a California man who uses marijuana to ease his cancer symptoms wept outside Federal Court on Monday after pleading her family's case to prevent his deportation. "I need to ask the Canadian people for help, because I'm losing the battle against saving my husband's life," Michele Kubby cried. Kubby argued on behalf of her husband Steve, who was too ill to attend the hearing. "To remove him from Canada is like removing a diabetic from his insulin," Kubby told Justice Yvon Pinard. Kubby, his wife and two young daughters, had been told to voluntarily leave Canada by Thursday or they will be forcibly removed. Pinard reserved his decision on the application for a stay of the deportation order without giving a date for judgment, but he confirmed the family wouldn't be removed from the country before he made his ruling. The Kubbys' application is the culmination of a lengthy legal and refugee claim process the family has been through since arriving from the United States in 2001. Steve Kubby, who has adrenal cancer, was allowed to smoke medical marijuana in California and was acquitted in a U.S. court when caught growing more than 260 marijuana plants at his home. However, he was convicted of possessing a small amount of mescaline and one stem from a magic mushroom. He was sentenced to three months of house arrest. Kubby escaped to Canada shortly after the conviction and made an unsuccessful refugee claim to stay in the country. Michele Kubby said her husband won't get the care he needs in jail, and certainly won't be able to smoke marijuana while serving his time. "Protect us from the zero-tolerance policy of the United States that will remove his medicine from him," she said. Keith Reimer, a lawyer for Citizenship and Immigration Canada, told the court the case comes down to the refugee board's decision. "It found . . . there is protection for medical marijuana users in the U.S," he said. "For him to say 'I would be thrown in jail and allowed to die' is speculative." Michele Kubby said the penalty for fleeing could bring a mandatory three-to four-year jail sentence, on top of his current sentence. "He will not survive in jail that long. And I am terrified, terrified for my family." Lawyer Douglas Wiatt, who has defended many medical marijuana patients in Washington state, attended Monday's hearing. Outside court, he said a recent U.S. Supreme Court decision has changed the tone around medical marijuana use. "The fact that anyone up here in Canada thinks that a medical marijuana patient is going to be treated well in the United States, it's a myth," Wiatt said. "My prediction for Mr. Kubby is he's a dead man if he winds up going back to the United States, because I don't think they'll get him out of jail fast enough." One of the couple's two daughters, nine-year-old Brooke, sat in the court gallery while her mother argued before the justice. Brook was surrounded by a dozen of Kubby's supporters, including Marc Emery, who's fighting an extradition proceeding to the United States where he's charged with operating a marijuana seed growing company. A Question
Toker00 that sounds like a nice outfit.I am looking towards what will probably happen on the 13th and I want to know if lawyers will be with the Kubbys thru this process if it comes to be. Will Michele stay in Canada and if not does she have a place to go? Many people are still fighting so they can stay and I say fight on but I want to know about the what ifs.

More on the disease called prohibition
"Ruth Collins-Nakai, president of the association, said "we are not taking a pro or con position. What the CMA is opposed to, is the current MMAR because we don't have the scientific evidence about the risks or benefits [of marijuana use]," Dr. Collins-Nakai said."So, Doctor Collins-Nakai suggests that they be turned over to the riskier judgments of the ignorant of any medical science judges, better yet, so that the even still more ignorant of any medical science lawyers, if these don't grind you down there is always those proud men in blue.May God have pity on these wretched souls.

You bring up so many good points. I want to look at this in my comment stepped back from emotion a little and say how I look at what is happening. Since this administration and then 9/11 people that seem to push too much against the system aren't tolerated like they might have been before. This is a law and order administration and we are expected to fall in line and march to their beat. That is my observation from a distant view.

I am really worried about Kubby
As with my case the gov't is refusing to rule until last minute so nothing can be done to stop it...we must all get ready to try and push Placer County to try to save Kubby's life. I fear that Steve may not survive this process, especially since his case will be state to state and not federal like mine which mean he will get to play diesel therapy for next 6 weeks whilst red-neck sheriffs (like the ones who tried to trick me into signing releases so they could hold me three times to torture me more) transfer him from jail to jail and state to state with a hearing at each stop and ZERO medical care in between...21st century witch test! This isn't right, looking back upon my suffering it all just seems so needless...they really are willing to kill us over a plant that we have to have to survive! I'm begging everybody who ever thought they owed me anything to try and do all they can to get this man and his poor family some peace, please! Call, write, beg, cry, plead, bribe, trade, sell or whatever you have to do to bring this bs to an end for them. Cancer isn't anything to play with and this man really is sick, and if there is any decency left in this world then Canadians will see all we EVER wanted was a little peace...instead we have been lied about and vilified by almost every Canadian official we have come across. What is it going to take for them to wake up to the reality of this desperate attempt by us to try and live a normal as possible life with what little we have left. What is it about medical cannabis that makes us disposable, because they wouldn't let a dog be treated the way I was and Kubby is fixing to be treated! Kubby's blood will be on every Canadians hands, and the Sin of indifference will rest upon every American's soul! Peace, Steve TuckPS...this is a little short that Allen sent me from NORML, thought some may want a preview... javascript:ol('http://www.norml.org/samsjourney.html');

Do This ...
I called both numbers, got voicemail, I hope their phones are melting with so many calls ...told him I was from Oklahoma.I asked Mr Volpe to save Steve Kubby's life by keeping Steve anf family in Canada. I pointed out that Canada has traditionally been a haven for those Americans who disagree with some of more egregious policies of our government, namely Viet-Nam and the drug war. I asked him not to back down, maintain independence from our madness.Every body call and say where you are from. Volpe must be taught that the whole of America is watching this.

My stomach just did a total flip when this republican from Kansas talked about killing children with Downs Syndrome. I ask who will pay for their health care if a parent can't deal emotionally or financially with a child with Downs Syndrome. I am against abortion but men making decisions over a woman's body is wrong in my eyes. Sorry for my off topic rant but that really got to me. bureaucratic cowardism
"Health Canada repealed the section, but a few months later, it quietly re-enacted the exact same restriction on producers. An "analysis statement" issued with the new regulations referred to the court's ruling as "untenable" and said it would result in Canada violating its international treaty obligations to restrict the distribution of marijuana."Right....gotta respect those treaties...you wouldn't want to get the "Holland treatment" from the rest of the world. The Netherlands has really been ostracized for their medical MJ distribution. The whole county has collapsed since making that move. People are starving, living in shanties. God bless Canada's government for having the courage to protect their citizens from the evil medicine.

Marc
I am sorry about how things are going in your country. You are one of my favorite Canadians. We are good people down here but this administration has gone way off to the right and it breaks my heart as I know it breaks your heart. I didn't vote for Bush and maybe when the time comes for voting again people will see they we need doves not hawks anymore.

Libertarians
The DEA loves murdering people in cold blood. They are heartless, ruthless, and should be disbanded. Gestapo tactics on medical cannabis users. How Nixon/Reagan/Bush/Clinton/Bush-y. (At least Carter tried)I read about another 68 year old victim of a wrong address drug raid, recently. SWAT was involved in a small amount cannabis bust. Why? To stay in practice? Why didn't regular police conduct raid? Or is SWAT our Regular Police now? What is the Libertarian Party, or individual members doing for the Kubbys'? Anything on their site about Kubby? All I can do is feel bad about his situation, and resolve to keep changing the laws.Wage peace on war. END CANNABIS PROHBITION NOW!

Dubya's Control Over Canada's Justice System
Dear Friends;"Bush" is Canada's Parliament "God" and we have to bow, kneel and abide by his rules..or else! Our sovereignty as an independent nation has gone down the drain since the free trade with U.S., the Patriot Act and Homeland Security. I'm really shocked and sad that a cancer patient like Steve has to fight for his right to live in Canada's highest court.Canada has granted Steve a medical marijuana exemption and our minister of health Ujjal Dosanjh should do something to protect him from being deported to his "DEATH" in the States! Our politicians should be ashamed! Good Luck Steve and Michele
I want to say what I said before. I don't know how to help with anything that happens in Canada but if you must come back we will be here for you.
