An advocate in support of medical marijuana use says the Supreme Court's decision to outlaw use of the drug will further heighten legal battles before U.S. courts. The Supreme Court ruled Monday that a federal law classifying the drug as illegal made no exception for ill patients.Many sufferers of AIDS, cancer, multiple sclerosis and other illnesses believe the drug helps combat the devastating effects of their diseases.
In the case of the Controlled Substances Act, the statute reflects a determination that marijuana has no medical benefits worthy of an exception, Justice Clarence Thomas said. Thomas noted the act states marijuana has "no currently accepted medical use."But Common Sense for Drug Policy President Kevin Zeese said the ruling is only going to heighten the conflict and force the federal government to bring the case before the California jurors."We will be forced by two things. The federal government will be on a mission to enforce the law and marijuana clubs will be on a mission to protect the seriously ill,' Zeese said. He said the controversy will be heightened since California supports medical use of marijuana."To enforce the law, the government will have to prosecute someone and this will go before the California jurors," Zeese said.Voters in Arizona, Alaska, California, Colorado, Maine, Nevada, Oregon and Washington also have approved ballot initiatives allowing the use of medical marijuana. In Hawaii, the legislature passed a similar law and the governor signed it last year.In March, attorneys presented oral arguments before the Supreme Court in a U.S v. Oakland Cannabis Buyers' Cooperative.
