Judge Hands Down Sentence In Marijuana Case

A Placer County judge Friday handed down a sentence in the medical marijuana case of Steve Kubby, but not before reducing all of the felony charges against Kubby to misdemeanors. Kubby and his supporters celebrated as he left the courtroom following the sentencing hearing. "People need to understand that when I was studying these substances and when I was involved in them, I was very close to death, and it was truly a spiritual issue. There was never any criminal intent," Kubby said.
He had faced two felony drug possession charges, but those charges were reduced to misdemeanors. Kubby was sentenced to three years of formal probation, 120 days of house arrest and a fine of $2,700. As a condition of his sentence, Kubby can be subject to search and seizure. But, he can continue to use marijuana for medicinal purposes. Kubby and his wife were arrested after a raid on their Squaw Valley home in January 1999. Police found more than 250 marijuana plants in the house. The Kubbys said that they had medical permission to use the drug.A jury deadlocked 11-1 last December on all counts related to the marijuana, but convicted Steve Kubby on two minor possession charges and acquitted his wife on another charge. Also Friday, the district attorney's office said that it would not retry Kubby on the drug charges. Judge Cosgrove
Judge Cosgrove is a very compassionate judge. He could have stayed with the felony convictions (and the prosecuting attorney said it was illegal for the judge to reduce the penalties, he through little fits throuought the sentencing). Steve and Michelle will be greatly missed here in California for rhe work they have done. I can understand their leaving the country, I'm sure they will continue to fight for our cause and to give canabis the recognition it deserves.

. . . and you said it so colorfully!This is a major victory for the good guys (that would be those of us who favor medical marijuana laws). Steve Kubby could have been senetenced to prison time (by his own words, such a sentence would have been a death sentence for him because he would have been deprived of his life-saving medication), and he could have been denied his right to medical marijuana under his probation terms. Instead, he gets no jail time, no felony record, and he can use the medicine that has been saving his life for 17 years. I am proud of this judge, and I am glad to see this outcome.
