Jurors in the marijuana-for-sale trial of Olympic Valley's Steve and Michele Kubby will resume deliberations Monday in Auburn. The eight-woman, four-man panel was given the case late Thursday and began deliberations Friday following a trial that spanned four months.On Friday, Judge John Cosgrove dismissed charges of hashish possession against the Kubbys. A concentrated form of marijuana, the hashish was found during a January 19, 1999 raid on the Kubbys' home, along with 265 pot plants.
J. David Nick, attorney for Michele Kubby, and J. Tony Serra, Steve Kubby's attorney, made the request to drop the charges at a hearing Friday. They argued hashish is a form of marijuana and shouldn't be considered in a separate count when the Kubbys are already charged with possession of cannabis for sale.With the possession of hashish charge removed, the jury will continue to consider the possession-of marijuana-for-sale allegation, plus charges of cultivating marijuana, conspiracy to grow and sell pot, plus possession of peyote and a magic mushroom stem.The Kubbys maintain that the grow was for their own medicinal use. Both had doctors' recommendations to use and grow pot under Prop. 215. AMMA: Kubby Jury Deadlocked 11-1     BREAKING NEWS:December 20, 2000Jurors told a substitute judge today that they are deadlocked 11-1, but judge refuses to say which way. A verdict of 12-0 was reached regarding the peyote for both Steve and Michele. A verdict of 12-0 was reached for Michele with regards to the mushroom stem; 11-1 for Steve.We believe the number show an acquittal for the peyote and for Michele on the mushroom stem. No one is calling it a hung jury yet, but Judge Cosgrove suggested today that a decision must either come tomorrow, or the jury will be returning in January to continue deliberations.Despite three long days of waiting, a diligent group of supporters maintain a vigil at the courthouse and remain in close contact with Mr. Serra, Mr. Nick and Ms. Hagen. These are the people who will receive 'the call' that announces that the jury has reached a verdict.Defense attorneys and supporters wait together in the DeWitt Diner, with great food and good service and they wait in the parking lot across from where the deliberations are going on. Stories are told and sometimes jokes but mostly real life tales of the War on Drugs toll on Americans who are the backbone of this country, tell us what has happened to them due to the Feds greed for land and control. I really hope and pray that the Kubby's are vindicated. They have to be. I think that the time the Jury is taking to decide means they are having trouble saying guilty. Let's hope the Jurors have a little Christmas Spirit in their hearts and realize what a conviction would do to this fine family.Peace, FoM!
