Wife Insists Pot Grown in Home Purely Medicinal

"I am not a criminal, nor is my husband," Michele Renee Kubby declared Tuesday as she described for a Placer County jury the medical, personal and political milieu in which she and former gubernatorial candidate Steve Kubby grew marijuana in their Olympic Valley home. "We did not sell marijuana," she stated emphatically.Her husband treated his crop with "reverence" and was too dependent on the "medicine" it provided to share it with others, Michele Kubby testified.
Funds provided by two San Francisco Bay Area cannabis clubs were "donations" to help the couple sustain their fight for the rights of medical marijuana patients everywhere, she said.She swore there was never a time when Steve Kubby delivered pot from his own harvest to those clubs.Michele Kubby's testimony will resume this morning before Judge John L. Cosgrove.She has yet to describe the January 1999 raid by authorities that resulted in the seizure of 265 marijuana plants in various stages of development from throughout the residence.The Kubbys are each charged with eight crimes, seven of them felonies, alleging numerous counts of possession, possession for sale, cultivation and conspiracy to commit a crime.They have launched an aggressive defense, with lawyers J. Tony Serra and J. David Nick contending the two were targeted by overzealous law enforcement officers because of Kubby's leadership role in the 1996 passage of Proposition 215, approving the use and cultivation of pot by seriously ill Californians.Steve Kubby, 54, was diagnosed with a rare and deadly form of adrenal cancer more than 16 years ago and turned to marijuana only after several forms of prescribed therapy failed, his former physician, Dr. Vincent DeQuattro, testified Tuesday.One particular therapy was experimental, and of the five or six of his patients who received it, "all of them are dead except Mr. Kubby," the doctor told the jury.DeQuattro said he is not normally an advocate of medical marijuana."No other patients in my office receive marijuana -- none," he said, but "I have the opinion that it helped him."He said that "in the context of him not being able to take other medications, I approved it.... I didn't want to take him off something that was keeping him alive."Michele Kubby, 34, has yet to testify about the medical condition that prompted her to join her husband as a pot user.She testified Tuesday that she knew nothing about marijuana when she met Steve during a ski outing in April 1995, but learned that it was his form of medication a few weeks later.
