Pot Case Goes to Court!

LONDON, Ont. A man whose wife has waged a lengthy court battle to legalize the use of marijuana for medicinal purposes is set to appear in court today to face charges of drug possession and trafficking.
Mike Harichy, 47, was charged Friday when police executed a search warrant at Boston Herb -- the London Cannabis Compassion Centre run by him and owned by his wife, Lynn. Mike Harichy said Tuesday he believed he had been harassed by London police. And Lynn Harichy, 37, said she believed police were out to get her husband before the couple closed their business. London police Insp. Dave Lucio denied the Harichys' allegations and her lawyer, Alan Young, of Toronto, declined comment on her statement. Lucio said police were not aware the business was about to close and weren't being opportunistic in laying the charges at the last possible opportunity. Boston Herb opened in July 1998 to provide marijuana to people with specific medical conditions such as AIDS, cancer and multiple sclerosis or people with a letter from their doctor endorsing marijuana use for other ailments. Lucio alleged Mike Harichy was selling marijuana to people who didn't have medical letters. Lynn Harichy said the centre was scheduled to close for good after a final delivery of marijuana to members last Friday. Police arrived with a warrant before those deliveries were made. She said if police had waited until after Friday's delivery, they would not have been able to charge her husband. Police said they seized 32.4 grams of marijuana in the raid. Lynn Harichy has multiple sclerosis and says she smokes marijuana to deal with chronic pain and nausea. The decision to close was made after the federal government announced last week it would look at beginning clinical trials on the medicinal uses of marijuana. http://www.canoe.com/TopStories/pot_mar10.html
