 A judge dismissed felony marijuana cultivation charges against a 55-year-old arthritis sufferer in what had promised to be the city's first medicinal-marijuana trials.David Zink, who was arrested Aug. 10 after police found 30 pot plants in his garden, could have faced up to eight years in prison if convicted. On Wednesday, Deputy District Attorney Karen Thorpe told the court that there was insufficient evidence to proceed, and Superior Court Judge James Pierce immediately dismissed the charges.
Police spokesman Steve Filippini said the case could later be refiled.Zink was undeterred."I plan to plant my garden again," said Zink, an activist for the legal use of marijuana under voter-approved Proposition 215. A few weeks after his arrest, Zink said, "Mark my words, what we will get out of this is an ordinance in Long Beach."Authorities, however, said earlier that Zink crossed the line when he was caught with 30 plants, ranging from 3 to 7 feet high. Proposition 215 allows a patient to grow pot with a doctor's note or a caregiver to grow it for others with doctor approval.Zink said he planned to smoke only one-third of the total crop himself over the course of the year.
