Judge Permits Ghosts On Kubby Jury

When former Laguna Beach resident Steve Kubby goes to the courtroom on Halloween for the continuing trial of the state's most high-profile marijuana case, the jury will be dressed up in costumes, Kubby enthusiastically told The Buzz on Friday. That's right -- witches and clowns and goblins and ghosts and maybe a Johnnie Cochran, for good measure. The Placer County jury made the unusual request of Judge John L. Cosgrove, who said, more or less, Cool.
"When we heard that, we thought, 'We won!,'" said Kubby. "If the jury was going to convict people, would they want to dress up?" Kubby, a cancer victim and former gubernatorial candidate, and his wife, Michele, are on trial for possession, cultivation, sale and possession for sale. The Kubbys say the pot was for medicinal purposes, as allowed under the initiative approved by voters in 1996. Both have notes from doctors recommending that they use it for medical conditions.Pollsters at California State University, Fullerton, say they weren't trying to make mischief - just gathering information that could be valuable someday. But the supplemental polling results given out at a Thursday press conference on how Orange County voters view various initiatives are likely to be a cause for heartburn among many of the county's leading politicians. A large majority of the 544 registered voters said they didn't recognize the names of any members of the Board of Supervisors. The least-recognized of the bunch: Chairman Charles V. Smith. Only 15 percent of voters had heard of Smith; only about 8 percent knew he was a supervisor. The best-known local politician? Anaheim Mayor Tom Daly, whose name was recognized by 42 percent of those surveyed. But only 8 percent knew his job. Meaning what? Meaning, suggested Cal State Fullerton professor Sandra Sutphen, that voters may have been thinking of the Daleys, father and son, who have been the high-profile mayors of Chicago for 32 of the past 45 years - not the Daly of Anaheim. I think Prosecution already lost...
According to this link, it sounds like the prosecution's case really fell apart big-time. Perhaps the jury realizes this? The chance of the Kubbys receiving a guilty verdict seems to be extremely small.

The prosecution team would have an easy time picking suitable attire; witch-burning Puritan cloaks, Nazi Party official uniforms and 17th Spanish Inquisition robes could be easily made. Though getting rubber masks of Hitler, Himmler, Eichmann, Heydrich, etc. would be much harder.This would be easier; they could go as the modern-day Boogeyman: someone dressed as a DrugWarrior in full regalia, with black jumpsuit, body armor and assault rifles, screaming at people to lie down or be shot like the Sepulveda boy was. (Ooops, I forgot; he was shot in the back *while* lying face down. Just a minor point, I guess. All an accident, anyway.)Yes, they have lots of suitable costumes to choose from. But the problem is that with these people, *every* day is "Trick or Treat" day with your Constitutional rights, which removes any pretense of humor from a deadly serious business. The Kubby's are on trial for their *lives*, here; the antis want to McWilliams them.Yes, this truly *is* a circus, a farce, a flaming absurdity which should never have been brought to this point. But it may prove to be the Waterloo for the antis. Their top 'experts' have been shown to be anything but a bunch of barely literate hacks ignorant of current research. If this process continues, the entire (supposedly scientific) basis behind prohibition may well be called into question. A major leg of the stool the antis depend upon to keep them upright will be sawed off.For the longest time, the antis have had things their own way. They've run roughshod over the average American's rights with impunity. They've been allowed to use substandard scientific research to back their arguments, which until now have remained unchallenged. They've gotten so used to thinking that this situation would maintain forever that they became lazy and complacent. And now, too late they realize the dangers in allowing this to go to trial. They're being shown up for fools on relying on questionable data. The next step, if the Kubby lawyers can swing it, is to present the whole sordid, racially motivated story of drug prohibition, as detailed in the PBS and History Channel series.Yep, it's Trick or Treat time for the antis, alright. But this time the shoe is on the other foot.

 This is most peculiar. It is hard to imagine a jury dressed up as goblins,ghosts,hobos,power rangers,and witches,,delivering a guilty verdict. It's kind of appropriate for such a circus-like trial.......dddd
