TAHOE CITY A visiting judge decided Tuesday that there is sufficient evidence for Steve and Michele Kubby to stand trial on charges that include possession of drugs for sale.
Modesto County Superior Court Judge Robert Compagna, presiding at a preliminary hearing in Placer County Superior Court's Tahoe Division, ordered the former gubernatorial candidate to be tried on 10 felony complaints and his wife on nine.Compagna scheduled the trial to begin at 1:30 p.m. March 19 in Auburn.Steve Kubby's attorney, Dale Wood of Truckee, and Michele Kubby's attorney, Joseph Farina of Elk Grove, said their clients maintain they grew marijuana for medicinal use only.Placer County Deputy District Attorney Christopher Cattran expanded the conspiracy count against each to include "conspiracy to possess for sale" and "conspiracy to cultivate."He also added charges of possession of controlled substances -- mescaline and hashish.According to testimony Tuesday, state Department of Justice tests have identified residue found in straw confiscated in a Jan. 19 raid of the couple's Olympic Valley home as mescaline, hashish, psychedelic mushrooms and cocaine.Special Agent Mick Mollica said he has concluded the 265 marijuana plants seized during the raid "were definitely cultivated for possession for sale."The high-quality plants, many in the budding stage, would have produced 20 pounds of finished product, Mollica said. He said doctors with whom he has worked say a heavy marijuana user, smoking five joints a day, would require only 11/2 pounds a year.Among items confiscated from the Kubby home, Mollica said, is a page from a daily planner that appears to contain wholesale prices for various marijuana hybrids.
