Wants Ruling On Cannabis Club Review Posted by FoM on July 29, 2000 at 07:55:05 PT Chronicle Staff Report Source: San Francisco Chronicle The Department of Justice asked the Supreme Court yesterday to review an appeals court ruling that led a district judge last week to allow an Oakland medicinal-marijuana club to dispense cannabis to seriously ill patients. Federal prosecutors said the appeals court erred in arguing that ``medical necessity is a defense'' from the absolute ban on marijuana under federal drug laws. The attorneys said the ruling last September ``threatens the government's ability to enforce the federal drug laws.'' Based on the appeals court decision, District Judge Charles Breyer last week modified his 1998 order that shut down several Northern California medicinal-marijuana clubs. The Justice Department is also appealing Breyer's ruling last week. Jeff Jones, executive director of the Oakland Cannabis Buyers' Cooperative, said yesterday that the club has not yet begun dispensing cannabis. Who are these attorneys? It is strange they would not name them. This is just an old ploy of passing the buck. Govt. now claims that their law enforcers cannot do their job. Ask any cop, he will say he is only doing his/her job because they are following the LAW. I do not understand their point because it seems to me that the enforcers have no problem arresting and killing sick people even when the people of Calif. already voted on this issue. What ability they are talking about? Impunity to murder the sick dying people? We the people had better make the changes. I work with young boys14-21 and they only see anarchy these days. We the people had better start realizing that, yes; these kids know what anarchy is. This is only true as long as the federal government refuses to regulate all drugs, instead giving black market dealers free reign over some of the most desired drugs and substances.
