A man found guilty of marijuana possession had his conviction overturned Tuesday because a former policeman said he falsified the arrest report.Porfirio Acosta, 41, was the 82nd person whose Superior Court conviction was reversed because of allegations that Rampart station anti-gang officers framed people. Eleven misdemeanor city attorney's cases have also been voided.
Acosta pleaded guilty in 1997 to possessing marijuana for sale. He was sentenced to 120 days in jail and three years probation, but the sentence was postponed until January 1998. A bench warrant was issued for Acosta's arrest when he failed to appear in court. In addition to overturning the conviction, Superior Court Commissioner Michael Price recalled the arrest warrant."He's free," said Marie Giralomo, the Los Angeles County deputy public defender who represented Acosta at trial. "This is good news."Prosecutors asked for dismissal of the conviction after Rafael Perez, the former officer who is the central figure in the Police Department scandal, gave a sworn statement in April that he fabricated portions of the arrest report.Although marijuana was found in Acosta's home and car, Perez said he lied about having obtained consent to conduct those searches, according to court documents.Los Angeles (AP) Published: June 13, 2000Copyright © The Sacramento BeeRelated Articles:MapInc. Where is it?
Right on freedom fighter,,Where is the outrage?Where are the pictures and news stories of all these CRIMINAL cops being thrown in jail? The crime of F*#CKING someones life,by planting false evidence,or lying in court,is far more serious than any drug bust. This is one area of law, where I think "zero tolerance",would be appropiate. When you are in law enforcement, and you are sleazy and arrogant enough to ruin someones life, the term;"mandatory minimum" should apply. I live in L.A.,,and I'll bet you the corruption that has been uncovered so far,is the tip of the iceberg.I also believe that the situation is just as bad,if not worse, amongst these gangsters in blue throughout the country.I'm not saying all cops are bad, quite the contrary. There are many honorable people in law enforcement who are earning an honest living. The very nature of law enfocement breeds an "us and them",mentality,a "good guys, bad guys" view of people, that is condusive to corruption. One more point;I'm sure you've noticed,if you've watched shows like "COPS",,and police video shows.Anyone caught with drugs,is referred to as a slimeball,,etc.thus enhancing the governments anti-drug propaganda.I'll bet you these shows are on the ondcps' payroll,,using money that was picked right out of your pocket.Think about it next time you pay your taxes. We are paying them,to wage war upon us..........disgusting.........dddd
