Hamilton district, police investigate allegations of teens getting high on bus.Drug charges against a Hamilton High School student who authorities said reeked of marijuana on his way to school came Tuesday as district officials and police investigated allegations of students smoking marijuana on a school bus.
"I am disturbed that there was an incident on the bus that required us to take action, but I am pleased that the administration was rigorous in investigating" and having students face consequences, Hamilton Schools Superintendent Kathleen Cooke said.Scott A. Emrich, 17, was found with a marijuana pipe March 6 by a school staff member who told a Waukesha County sheriff's deputy working with the school that Emrich "entered the school bus reeking of the odor of marijuana," according to a criminal complaint filed Tuesday in Waukesha County Circuit Court.Emrich was charged with possession of drug paraphernalia, which carries maximum penalties of $500 in fines and 30 days in jail upon conviction, the complaint says.If convicted, he could also lose his driving privileges for up to five years.According to the criminal complaint:Emrich initially denied to a sheriff's deputy that he had been smoking marijuana, but a search of his clothing produced a marijuana pipe. Emrich said he found the pipe on the bus three days earlier but later admitted that he had purchased the pieces for the pipe at a hardware store and had constructed it himself. He also said he had used the pipe to smoke marijuana.A school staffer had been assigned by the district to ride Emrich's school bus after the school district received several complaints - including some from drivers at the bus company - regarding students smoking marijuana on the bus.The bus runs a route out of Butler, and Butler police Lt. Michael Cosgrove confirmed Tuesday that his department is involved in an investigation with the Waukesha County Sheriff's Department."It's specific to a small group of individuals," Cosgrove said. "It's not everybody on the bus."Superintendent Cooke said the Hamilton School District has "low tolerance for alcohol and drug abuse.""We have very intensive prevention programs," she said. Why paraphenalia laws fail
The obvious and troubling aspects of use by minors aside, there's something else which I feel needs to be pointed out. Look at this:Emrich said he found the pipe on the bus three days earlier but later admitted that he had purchased the pieces for the pipe at a hardware store and had constructed it himself. He also said he had used the pipe to smoke marijuana.Just as with the consumption of illicit drugs, themselves, the *means* of doing so simply cannot be legislated out of existence. If anything, such simple-minded attempts at social control have spawned bursts of creativity amongst the very people these laws are meant to hurt. And the results have sometimes proven to be very aesthetically pleasing as well as functional, belying the myth that potheads are a lazy, uncreative lot.But the knuckledragging antis, in their murky, dimwitted, reflexive attempts to crush what they fear and hate, will continue to play right into the hands of those they can barely sense are running rings around them. If only they had the wit to realize what a sisyphean task they have set for themselves. But I guess that's asking too much.
