Mendocino voters will weigh in on whether recreational pot smoking should be legal, despite lawyers' opinions that such a vote would be meaningless.County supervisors voted unanimously Tuesday to put an initiative to legalize recreational marijuana on the November ballot.
The measure would forbid local law-enforcement from hassling anyone with 25 or fewer "adult flowering female marijuana plants or the equivalent in dried marijuana."The supervisors could have passed the new rules as an ordinance.The Green Party-sponsored initiative is perceived more as a statement about marijuana than as a way to challenge state and federal laws against the sale, growth and use of pot."It is nothing more than a policy statement. It's clearly illegal," said Michael Delbar, chairman of the Board of Supervisors.County Counsel Peter Klein said the initiative, if approved, would be unenforceable. Sheriff Tony Craver and District Attorney Norm Vroman agreed.Medical marijuana is legal under California law, but not under federal law.Ukiah, Calif.
