Kubby Trial Postponed While Attorney Unavailable

The medical marijuana trial of Steven and Michele Kubby hit another snag Tuesday when one of the Kubbys' attorneys ran into a scheduling conflict with a Sacramento County court.Joseph Farina, who represents Michele Kubby, had a court-appointed case in Sacramento and was unable to appear in Auburn until the afternoon. 
Farina said the case could last through the week if his client decides not to plea bargain.Judge James L. Roeder, though, was able to set a tentative timeframe for the Kubby trial once Farina appeared. Jury selection should begin next Tuesday and opening arguments are tentatively set for March 5.Assistant District Attorney Chris Cattran estimated it would take most of the month of March to present the prosecution's case while the defense estimated about half of that time to present their evidence.Although the trial could last for roughly two months, Roeder said his court calendar looks clear."It looks like we're going to be able to rock and roll through mid-April," he said.Farina, though, said he was concerned with the amount of discovery still being handed over from the District Attorney's Office."It's like a waterfall that doesn't stop," he said.Roeder instructed lawyers for both sides to come together on a questionnaire for potential jurors and be ready to present motions by 9 a.m. Monday.
