Fresno AMMA Press Release

Three years ago today, a majority of Californians passed Proposition 215. That law changed the laws of the State of California to allow for the possession and cultivation of marijuana by anyone whose doctor has recommended the use of marijuana for the treatment of a medical condition or its symptoms.
Yet in the intervening three years, not only has the government failed to establish any guidelines for citizens to follow to insure compliance with the law, but around the state, law enforcement has actively pursued the prosecution, and persecution, of the sick and dying despite the protection that the new law is supposed to afford. For that reason, today, all around the country, governments are being informed by local citizens that the American Medical Marijuana Association (AMMA) has been launched. The purpose of this new organization is to petition governments for the redress of this grievance. Our goal is to persuade state and local governments to enact guidelines by which citizens can be sure that their reliance on laws permitting the medical use of marijuana will protect them from arrest, incarceration, prosecution, and the destruction of their supplies of medicine. After careful study, the City of Oakland enacted a set of guidelines, clearly defined, which will enable the sick, their caregivers, and law enforcement officials to measure how much marijuana may legitimately be possessed and/or cultivated under the law. These guidelines, based upon the federal government’s provision of medical marijuana to 8 patients for over 20 years, should be a model for other governments to follow. Additionally, we would like to see a patient registry established, which would issue an ID card to every certified medical marijuana patient and their caregivers which will enable them to quickly provide proof to any law enforcement officials who question the legitimacy of their possession or cultivation. The driving force behind the creation of the new organization is Steve Kubby. Kubby was one of the driving forces behind the passage of Proposition 215 in 1996. In 1998, Steve ran for Governor of California on the Libertarian Party ticket. Kubby has been a documented medical marijuana patient for almost 20 years. At that time, his doctors gave him six months to live due to a rare, and always fatal form of cancer of the adrenal gland. He attributes his continued vitality to his usage of medical marijuana. Despite his best efforts to comply with the laws of California, Steve, and his wife Michelle, were arrested in February 1999, and charged with cultivation and possession for purposes of sale of marijuana. His supplies of medicine were seized and destroyed. He nearly died from his one night of jail before a judge released him on his own recognizance. His family has been forced into bankruptcy because the computers which enable him to run his online magazine company were seized during his arrest. He and his wife are set for trial in February 2000. Steve’s story is one of dozens of similar cases around the state. It is to prevent these atrocities that this organization has been launched. Here in Fresno, Jonathan Richter has been appointed the local director. He will begin the process of distributing copies of the Oakland guidelines to local government officials, and rallying support of the local community to push for their adoption in Fresno County The American Medical Marijuana Association Web site: http://www.kubby.com/AMMA.htmlSubscribe: AMMA-Talk-on list.kubby.comUnsubscribe: AMMA-Talk-off list.kubby.com COUNTY DIRECTORS: ALAMEDA: Jeff Jones: JEFFJ RXCBC.ORG CALAVERAS: David Jack: JACKS GOLDRUSH.COM FRESNO: Jonathan Richter: JONRICHTER EMAIL.MSN.COM LOS ANGELES: Jim Rosenfield: JNR INSIGHTWEB.COM ORANGE: Doug Scribner: DOUG 123ABC.NET PLACER: Mike Baldwin: BALDWIN777 HOTMAIL.COM SAN LUIS OBISPO: Jo-D and Tom-E Dunbar: DUNBAR THEGRID.NET Related Article:Welcome to the AMMA Home Page - 11/07/99http://www.cannabisnews.com/news/thread3588.shtml
