A 63-year-old woman accused of marijuana possession made her first court appearance Monday after telling investigators she bought the drug by mail from California and is ``in pain and is sick,'' court records said. 
Delphia Toney of Hazel Green also told investigators she has smoked marijuana for about 50 years and has been getting it through the mail from California for about a year, the criminal complaint said. Toney was freed on a $1,000 signature bond after appearing without an attorney in Grant County Circuit Court on misdemeanor charges of marijuana possession and possession of drug paraphernalia. Circuit Court Judge Robert Van Hey set her arraignment for Sept. 27. Several hours after Monday's court appearance, Toney said she had a public defender as her attorney. ``I am not making any statements until I talk to my attorney. We have our first visit to talk next Friday,'' Toney said in a telephone interview from her home. Toney told WISC-TV in Madison she has a stomach condition that would have been aggravated by normal pain killers. ``The defendant stated she buys the marijuana because she is in pain and is sick,'' according to the complaint. ``She has been getting it from California for about a year and that she previously didn't use it for pain.'' Grant County Public Defender Rose Oliveto did not immediately return a telephone message Monday left by The Associated Press. Toney was arrested Aug. 6 after a postal inspector delivered a package to her home, according to the complaint. Officers seized about 4 ounces of marijuana after Toney pulled plastic bags out of another plastic bag inside some coffee grounds she had received as part of the priority mail package that she had placed underneath a sink, the complaint said. Investigators also recovered a ``pot pipe,'' according to the complaint. Toney said she got a two-month supply of marijuana for $280 from an undisclosed source in California ``with her daughter being the middle person,'' the complaint said. Toney also told police she had given some marijuana to others to take home, the complaint said. Toney told investigators that ``early in her life hemp plants grew in the area and everyone smoked it,'' the complaint said. Hazel Green Police Chief Michael Gorham defended the arrest of the Toney. ``At what point do you say that it's not OK for the 18-year-old and then do you have a double standard for a person who is 63?''
