Lansing -- Michigan’s medical marijuana law has been abused, exploited and hijacked by pot profiteers, said state Attorney General Bill Schuette in pushing a package of bills that will close loopholes in the law that was intended to provide pot to people with terminal, debilitating and chronic diseases.“The law has been hijacked by drug dealers who want to make money, line their pockets and make a huge profit,” Schuette said at a news conference this morning where he was flanked by lawmakers, police, prosecutors and doctors. “This law has as many holes as Swiss cheese. It’s out of control and we need to fix it.”
Legislators plan to introduce a package of eight bills in the fall that would: prohibit felons from becoming certified caregivers or people from getting medical marijuana certificates on line; strengthen the doctor-patient relationship in terms of giving out and receiving certificates; regulate the placement of medical marijuana dispensaries, prohibit driving under the influence of any amount of marijuana and clarify the definition of a debilitating medical condition that would allow a person to get a medical marijuana certificate.“We have a goal of protecting public safety while preserving the legitimate right of people who need medical marijuana,” said state Rep. John Walsh, R-Livonia.State Sen. Rick Jones, R-Grand Ledge, said he’d also like to see a simple saliva test developed, similar to a portable breathalyzer test, that would immediately show if a person is under the influence of pot.Dr. Steven Newman, president of the Michigan State Medical Society, said the law passed in 2008 is poorly worded and has led to confusion for both patients and physicians.“What we’re most interested in is getting a bona fide physician-patient relationship that we can define,” Newman said. And while the package of bills doesn’t specifically address the legality of pot dispensaries, Schuette has argued to the court of appeals that the law doesn’t allow for dispensaries and that they should be outlawed.Source: Detroit Free Press (MI)Author: Kathleen Gray, Detroit Free Press Staff WriterPublished: August 10, 2011Copyright: 2011 Detroit Free PressWebsite: http://www.freep.com/Contact: letters freepress.comURL: http://drugsense.org/url/7dBbRLYeCannabisNews Medical Marijuana Archiveshttp://cannabisnews.com/news/list/medical.shtml

Welcome to C-News. You may have been here for a while, but I don't remember seeing your handle before this.Is that "[I ] Hope they read this!" or "Hope, they read this!"?If the latter: Reading the comments from your link, I get the impression that they, the voters of your area, often are reading this.If the former: If you are speaking of they, the government officials and the law enforcers, I agree with you that they need to become better informed on this issue and to stop grandstanding on the taxpayers' dollars.

Hope they read this!
I live in the very conservative Livingston Co. here in Michigan, recently The Livingston Daily Argus, a local newspaper, printed a story concerning a Readers Panel's replies to a recent post from Michigan's Attorney General, "Billy Bong" Schuette complaining that we are abusing the Medical Marijuana Law. Seeing that we are considered an 'ultra' conservative area, the folks here are certainly 'enlightened' in their views on how Mr. Schuette is skewing the law of the land...http://www.livingstondaily.com/article/20110821/OPINION01/108210310/Readers-share-insights-Mich-medical-marijuana-rules Mr. Schuette says that states should have sovereignty when it comes to federal interference in our Medical insurance, yet claims federal jurisdiction over medical cannabis. Speaks with a forked tongue, this snake does!

Too honest for my own good!
When I first met my "then Wife to be" during general conversation she asked me If I ever thought I would get married? I said I don't think I would marry a woman who would settle for me as a mate. I would want someone with better taste than that!

I'm glad you liked it. After the rain today had stopped I was watching the fog roll in and up over the fields. I looked and saw the sun behind the house and went out and took a few pictures. There is nothing more beautiful then Mother Nature displaying her full glory.

That's the song. I'm glad I found that CD. I put a bunch of different songs on it that I liked. We were given a loaner when the Jeep went in for service and it was very uncomfortable. It was a 2010 with low mileage. I can raise the seat in the Jeep and get the seat up high where I see over the steering wheel. I can move it forward and have my foot on the accelerator not just my toes. Most cars I look right into the top of the steering wheel.

Quicksilver Messenger Service - What About Me?
http://www.youtube.com/watch?v=ENi04LAdmLYYou poisoned my sweet water.
You cut down my green trees.
The food you fed my children
Was the cause of their disease.
My world is slowly fallin' down
And the airs not good to breathe.
And those of us who care enough,
We have to do something.......
(Chorus)
Oh.......oh What you gonna do about me?
Oh.......oh What you gonna do about me?
Your newspapers,
They just put you on.
They never tell you
The whole story.
They just put your
Young ideas down.
I was wonderin' could this be the end
Of your pride and glory?
(Chorus)
I work in your factory.
I study in your schools.
I fill your penitentiaries.
And your military too!
And I feel the future trembling,
As the word is passed around.
"If you stand up for what you do believe,
Be prepared to be shot down."
(Chorus)
And I feel like a stranger
In the land where I was born
And I live like an outlaw.
An' I'm always on the run..........................
An Im always getting busted
And I got to take a stand........
I believe the revolution
Must be mighty close at hand.......................
(Chorus)
I smoke marijuana
But I cant get behind your wars.
And most of what I do believe
Is against most of your laws
I'm a fugitive from injustice
But I'm goin' to be free.
Cause your rules and regulations
They dont do the thing for me
(Chorus)
And I feel like a stranger
In the land where I was born
And I live just like an outlaw.
An' I'm always on the run.

Have a great day. Yesterday I washed the Jeep. I know that seems like nothing but after driving such and old rundown car for so many years it was fun. I am grateful we had the old Mercury but going to the VA hospital in Cleveland would have been impossible in the condition it was in. PS: On a CD I put together a couple years ago one of the songs reminds me of you. It was What About Me by QMS. I smiled.

I am outside washing the Jeep. I had made a CD of different songs when Obama was running for President in 08. I forgot I had it. A voice.
When the injustice was already so very appalling. When the excrement of the War on Drugs was so deep. The murdered children of the drug war cried out to me. It was appalling. The murdered dead cried out to me. Young and old.I did want to speak up for people who were being treated so unjustly but that seemed to have no voice. People were being hideously wronged. After hitting the information highway in the late nineties, first at DrugSense and then here, I found people who thought exactly like I did in so many ways. They were literate, friendly, and easy to speak to through this huge drum of communication... the Internet. We needed encouragement. We still need it. We were literally fighting against a megalith, a juggernaut. Something huge... governments all over the world. A world wide bureaucracy of the worst sort... the killing sort. It's not been easy to keep up with all this. Or pleasant. It's hard and discouraging. We encouraged each other. Here at C-News, years ago, after I would comment someone would often say that was "exactly" how they felt and they thanked me for putting it into words for them. People did that with FoM, Kap, BGreen, Observer, Greenmed, the Sams... so MANY! I decided not to be quiet... or just say something and then be quiet, as is prudent in these matters, because I was perhaps helping someone and defending the defenseless... as I was often helped by someone else, by freeing something in someone's mind, by writing down their feelings in words... in black and white. "Yes! That's how I feel, too!" Apparently, I, and others, could bring a certain peace and clarity perhaps to even one person. "Yes! That's how I feel about it, only I couldn't get it into words. The right words." And I was, hopefully... speaking for the murdered, assaulted, the robbed, the imprisoned, and the ruined, that were all too quiet. And "The Children".Yes. I'm furious. But when I speak, I don't want people to just know that I'm angry. I want you, the prohibitionists, and you, my cohorts, to be very clear about what I'm furious about here. I want you to understand me. I want to be clearly understood. I want to say what the injured and totally distraught couldn't say in their own defense. I don't need to get in a cussing contest and lose track of the whole point of it all. C-News has certainly helped me with that. Martha's expectations are high. I don't need to get in a cussing contest, but I do need to say out loud, in public, how I feel about all this. When it all comes down to who did what to who or whom... I want it to be clear that I do not and did not approve of this treatment of people brought on by the so called "War on Drugs".

Thank You All
I have met some amazing people here. We have been happy, disappointed, sad and every other emotion. We have come a long way. I knew when the RP won back the House we would be in for a rough ride. The RP always reminds me of the class bully that will never let others learn and think. They work so hard to drown out ideas and fuel hate. I hope 2012 isn't as bad as I feel it could be. I had bullys in riding classes and the only ones that suffered were the good children. They would carry on until they had your undivided attention. I finally had to talk to the parents and avoid the child's antics. One girl when she didn't get my attention started beating her horse. That's how bad bullys can be. The RP is full of bullys.

I'm surprised you never hear about those. I see them all the time, although normally in the paper it will just say someone was convicted for DWI, sometimes DWI-drugs. I just had one of those cases recently. Several people had called in to report a driver who was all over the road almost running them off the road. He hit a truck. He failed all his field sobriety tests when he was pulled over. The officer described him as being completely out of it. The dashboard video and the video from the jail confirmed that. He tested positive for muscle relaxers and benzodiazepine (drugs like Xanax) that he had been prescribed. Positive drug test results are not enough for a DWI ( DUI--whatever they call it in your state) conviction though. They have to have evidence in most states that someone is impaired to the point that he was a danger to persons and property, unless the person has a blood alcohol content over the legal limit. They haven't come up with a legal limit of THC or THC metabolites anywhere though that is a good indicator of whether a person might be impaired to the point that it's dangerous for him to drive. The amount of THC it takes to cause that kind of impairment varies depending on the person and how often they smoke and all that. But they don't really need a test like that to get convictions and certainly not to arrest a driver and take him off the road. They don't have tests like that for any other drugs that cause impairment and people are convicted all the time for driving while impaired on these substances. I'm sure it happens where you live too. People can get really wasted on benzos, pain meds, muscle relaxers, and especially combinations of those drugs, and it is not uncommon at all for us to have people wasted on these substances driving on our roads.

Thanks for the clarification. Yes, it seems the sensible approach is to address truly impaired driving, not unrelated, past use.I never see any DUI arrests or accidents related to pharmaceuticals in our papers. To me, when I hear a prohibitionist allude to "any amount of marijuana" in the system, it says blind, "zero tolerance" metabolite testing, either urine, blood or hair. As we know, these test have nothing to do with current state of being "under the influence", much less whether there is "impairment" or not. Such zero tolerance tests, both public and private, are a privacy diminishing, invasive tactic that I predict prohibitionists will use increasingly, to wage war and exert control on those who chose to oppose cannabis prohibition and exercise their freedom of choice. And runruff, I always enjoy your comments, whether they are justifiably biting or simply humorous. Sometimes I wish CNews had a thumbs up "like" button for postings so we could express approval without adding comments.
But, we all know it's generally a mutual love and appreciation fest here.

driving under the influence of marijuana
Dongenero, on driving under the influence of pharmaceutical medications, most if not all states prohibit driving while impared on these substances. I'm an attorney in court a lot and I've seen an awful lot of cases where people are charged with DWI because they were driving while impaired on these drugs, even if these were meds that were prescribed to them. They prove these cases like they would prove a DWI without a breath or blood test. They put on testimony about how intoxicated a person was, show the videos if there are any, etc. Most of the time the defendants are either found guilty or they plead guilty or no contest.I don't know exactly what they are proposing here with respect to marijuana, but just what I'm reading in this article sounds like a zero tolerance law where if they find any THC metabolites in your system you're guilty. Those slaive tests aren't very accurate and while nothing will show up on those if you haven't smoked in something like 24 hours (not sure on that but it's much less time than on urine tests), a hot saliva test does not indicate that you are in any way intoxicated or impaired by marijuana. This is just a way to pick on pot smokers and discourage anyone from smoking it, even if they do so responsibly and never drive while impaired.

Speaking for myself, I don't recall ever being offended by anything you've expressed here on CNews.Considering your experience with the legal system, I'd say you have every right to use as much c*l*r4*l language as you like to thunder your frustration with prohibition. Instead you've shown remarkable resilience and restraint, imho.On the same hand, your way with words ("DEAsaurus Wrecks", "testosteronial testimonials") never fails to bring a smile!

sometimes my frustration and anger steams over. I don't want to sound too rusty or in anyway inappropriate? Sometimes the anger I feel associated with this morass, this modern day 'Inquisition" the smirk on Mickey Leonhart's face...well I sometimes repress the words I feel like using in favor of less colorful expressions. If ever I have offended anyone here I apologize!

We have made great progress over the years and we no longer have to fear, at least for the next 6 years or so, going back to square one.If we don't get a great deal done in the next 6 years I would be very surprised.

Hope
This truly is a wonderful forum.CNews feels almost like family to me. I've been informed, entertained, had my heart touched. From time to time, there may be differences in viewpoints, but they seem uniformly well informed and discussed in civil fashion to everybody's benefit. Not to be sexist, but I think that might not be the case without the ladies' influence; like attracts like. You and FoM keep CNews, this welcoming place, grounded. It's natural to want to be polite guests when pulling up a chair to the hearth. All I can say is thank you both, and everybody who posts their ideas and insights. Peace to all those who read and are informed.greenmed

stubborn AG
AG Mr. Schuette has consistently opposed access to medical cannabis, changing fear tactics to suit his prohibitionist agenda. A few years ago he was primary leader of a group calling itself "Citizens Protecting Michigan Kids" that encouraged NO to medical access. The Electorate decided otherwise. Michigander patients now have the right to their medicine. Has the sky fallen since 2008?But Mr. Schuette does not give up. At least he no longer works the "protect the children" gambit into his rhetoric. Here's a great, wise thread from a few years back...http://cannabisnews.com/news/24/thread24199.shtmlThe usual suspects back then? Same as the new ones.Excerpt:"A spokesman for the coalition ["Citizens Protecting Michigan Kids"] said it will be led by Appeals Court Judge Bill Schuette and former Michigan Chamber of Commerce President James Barrett, and will include the Michigan State Medical Society, the Prosecuting Attorneys Association and the Michigan Sheriff’s Association. "[my edit]Cannabiphobes, all of them.Again, we won't be fooled.

Usual Suspects
Did you notice that all the people trying to make regulations to "protect" patients all have an "R" after their name. Like I said, the Usual Suspects.

This caught my bloodshot eyes!
“We have a goal of protecting public safety while preserving the legitimate right of people who need medical marijuana,” said state Rep. John Walsh, R-Livonia.Making choices for people who have a right to decide for themselves is not "protecting public safety" anymore than...well, you know, it's just not their jobs to decide on my medicine. But go a bit further> What is this business of measuring how much euphoria I am allowed. When I am allowed to experience it and by which means I may choose to arrive there? It can in no way shape or form be his business, anyone's business! So, when he speaks of what his responsibilities are he should also keep in mind what my rights are too! It is not his responsibility to usurp my rights!

blurry policy
“The law has been hijacked by drug dealers who want to make money, line their pockets and make a huge profit,”.....sounds like the pharmaceutical industry...."prohibit driving under the influence of any amount of marijuana"...."similar to a portable breathalyzer test"What is the current policy for driving under the influence of pharmaceutical medications? We are talking about medications right, not recreational alcohol?
