Texas -- Country music superstar Willie Nelson was arrested Friday morning for allegedly having about 6 ounces of marijuana after his tour bus was stopped at the Border Patrol checkpoint in Sierra Blanca, about 85 miles east of El Paso. He posted bond and was released shortly after.Nelson, 77, was traveling from California to Austin, where he owns a ranch.
Nelson, who has written hundreds of songs including "Crazy," "Whiskey River" and "On the Road Again," was stopped at the checkpoint about 9 a.m. Border Patrol agents searched Nelson's tour bus and found the marijuana, which Nelson claimed was his, said Hudspeth County Sheriff Arvin West. Nelson, who has performed duets with Toby Keith, Julio Iglesias, George Jones and many more, was taken into custody and booked into the Hudspeth County Jail. West said that Nelson posted a $2,500 bond and was on the road again by 1:30 p.m. Friday. "It's kind of surprising, but, I mean, we treat him like anybody else," West said."He could get 180 days in county jail, which if he does, I'm going to make him cook and clean," West said. "He can wear the stripy uniforms just like the other ones do."A court date has yet to be set.The Border Patrol checkpoint along Interstate 10 at Sierra Blanca averages 10 to 15 drug-related arrests a day West said, and he expects several more arrests during the weekend as holiday travelers pack the road. It's great to see you. We were going east out of El Paso years ago and they had a check point. We drove in and they flagged us on to keep going. They had an Asian appearing man going in to check his information. Willie shouldn't have been stopped.

I can't speak for Willie, but as I myself get on in years, I find I have less and less interest in attempting to accommodate the bullies, petty bureaucrats, puritans, busybodies, fundamentalists and would-be gestapo who are hell-bent on turning our country into a corporate police/security state.Willie's a scrapper. He's been in bar fight or two...he knows that the biggest bullies are usually the biggest cowards. At 77, you've got to believe there's not much threat or punishment that carries a lot of weight with Willie. On the Prohibitionist side of the aisle, there's little to gain and much to lose by pushing Willie too hard.As afterburner suggests, this incident could generate a defense based on the Equal Protection Clause of the Fourteenth Amendment. (Remember Bush v. Gore?) The argument would be something to the effect that by denying Willie-and by extension, all Texans-access to medicines available to citizens in other states, the State of Texas has abridged Mr. Nelson's constitutional rights. In my fantasy, the State of Texas would then be put in the position of trying to prove that cannabis was NOT medicine, at which time, in a dramatic courtroom flourish covered by international media, Willie Nelson's lawyer introduces as evidence Granny Storm Crow's 420 page MMJ list.God Bless America. He already said it was his.}If Texas considers cannabis to be schedule one, then Willie could plead not guilty to non-medical cannabis possession since his statement shows that he uses cannabis to alleviate a medical condition called "stress." He could mount a constitutional challenge that sufficient scientific medical cannabis evidence already exists. Medical utility is an internationally proven reality for a massive proportion of earth's populace. This, makes any law based on denying medical effect to be unconstitutional in not providing equal access to medical cannabis as other states do. Not due process. ego transcendence or ego destruction, that is the question.

I know Texas is a hard state but Willie Nelson has done so much good for so many people and is such a kind man they can't put him in jail. If they really tried it could turn into a big deal. Willie Nelson and marijuana have always been thought of together. Willie's bus is notorious. I would be really upset if they mess with Willie Nelson.

We may have to come up with the outrage.
I've no doubt there are people who would give him the maximum sentence without batting an eyelash. They'd say, "The law's the law", and "We have to treat him like we'd treat anyone else".It's not good. I'm worried about it.Yes. He's in trouble. This is Texas. These laws are unfair and unjust... but people just ignore it and let it go on and on and on. These laws have hurt so many people. They've sent a lot of people to prison in this state over marijuana. I don't see people standing up for Willie any more than they have for anyone else.Maybe they'll have sensible mercy on him... but I have every reason to doubt that that'll be the case.I'm afraid there are those that despise him and would love to come down on him as hard as they can. There the ones that feel he should have been made "an example" of (of what asses THEY can be) about the cannabis/marijuana laws, a long time ago.I'm worried about him. I really am. This has got to be very stressful on him, too.
