Oakland -- Less than a year after the U.S. Supreme Court ruled against her, Oakland medical marijuana patient and advocate Angel Raich will go back before a federal appeals court Monday with a different legal argument. Her lawyers will try to persuade a three-judge panel of the 9th U.S. Circuit Court of Appeals, sitting in Pasadena, that keeping her from using marijuana as medicine unduly burdens her fundamental rights to life and freedom from pain, as protected by the Fifth Amendment's Due Process Clause and the Ninth Amendment.
The government argues there is no constitutionally protected fundamental right to obtain and use marijuana in defiance of the federal ban on the drug. "Nor can plaintiffs establish that the use of any particular drug, free of a regulatory scheme designed to protect the public health and safety, is a fundamental right that is deeply rooted in our nation's history, legal traditions and practices," wrote Assistant U.S. Attorney Mark Quinlivan in his January brief to the appeals court. Each side will have 30 minutes to argue its case. It will probably be months before the court rules. Raich, Diane Monson of Oroville, and two unnamed providers sued the government in October 2002 to prevent any interference with their medical marijuana use, but this case's seeds were sown in the Supreme Court's May 2001 decision on the Oakland Cannabis Buyers Cooperative's case. The court in that case ruled there is no collective medical necessity exception to the federal ban, which defines marijuana as having no valid medical use. But it did not rule on constitutional questions underlying the medical marijuana debate, so Raich, Monson and their lawyers tailor-made a case raising exactly those issues. A federal judge in San Francisco rejected their arguments in March 2003, but a 9th Circuit appeal panel reversed that ruling nine months later. That panel believed the plaintiffs could prevail at trial on their claim that the Constitution's Commerce Clause lets Congress regulate only interstate commerce, and that Californians' medical marijuana use neither crosses state lines nor involves money changing hands. The U.S. Supreme Court heard the case in November 2004 and in June 2005 ruled 6-3 to uphold the federal ban, finding that even marijuana grown in back yards for personal medical use can affect or contribute to the illegal interstate market for marijuana and therefore is within Congress' constitutional reach. But the 9th Circuit panel and the Supreme Court dealt only with the Commerce Clause argument, not the other constitutional issues. With the case remanded back to the 9th Circuit, Raich's attorneys now are pursuing the remaining arguments; Monson dropped out of the case late last year. Besides the Fifth- and Ninth-Amendment arguments, Raich's lawyers also claim the common-law doctrine of necessity — the idea that it's OK to break the law when forces beyond one's control compel it and there is no reasonable, legal alternative — bars the government from applying the Controlled Substances Act to ban medically necessary activities. The government argues the Supreme Court's decision in the Oakland Cannabis Buyers Cooperative case already ruled out a medical-necessity argument. And Raich's lawyers claim the Tenth Amendment protects against federal interference with state regulation of personal, noncommercial medical activities within their own borders — namely, medical marijuana laws. But the government says the Supreme Court's rejection of the Commerce Clause argument last year already covered that ground. "I know we're going to win, I feel pretty good about the 9th Circuit," Raich said Friday. Raich says without the drug's appetite boost, her wasting syndrome causes rapid, life-threatening weight loss. She also suffers from ailments including an inoperable brain tumor and nonepileptic seizures, and in November she had a hysterectomy following her precervical-cancer diagnosis. Meanwhile, she is planning a Capitol Hill lobbying blitz with renowned talk-show host and fellow medical marijuana user Montel Williams, to begin perhaps as early as May. The House last June defeated an amendment that would have forbidden the Justice Department from using public money to raid, arrest or prosecute patients and providers in states with medical marijuana laws. The amendment got 161 votes — more votes than in 2003 and 2004 — but still fell 57 short of the 218 it needed for passage. The good news is I have hooked up with a little powerhouse from Canada who is the top leading female speaker for LEAP (Law enforcement against prohibition) This young lady is amazing and starting tomorrow we will begin a media project to tell the world about Judge C Ashley Pike goal of sentencing one million man years before he retires..... That judge should have never said that aloud! ..... The bad news is that there judges like that out there..... I have filed a form with the ACLU and awaiting their response.....

Randy brush Update
This was a call last week from Randy .. I have talked to him 3 times so far 
Randy sends his love to everyone.... I asked Randy about how they were treating him in jail. Randy says they are being real good to him. That the jailers just shake their head saying he doesn't belong there. He is praying (which a blessing) He was in good spirits... I asked about the food.. He sighed and said Its not real heart friendly..Randy has a very strict diet and 
.. lucky for him his roomies in jail are heart friendly. They give him their fruits and veg .. Randy say's the prisoners are real cool with him too. I sure do miss my buddy... I sure hope he gets good C O's (guards) in prison system.... They exist... just hard to find.. He wants us all working for his release..... He wants us all telling everyone we meet about medical marijuana. and his case .... He wants lots of letters and he thanks everyone for the ones hes received.

This judge had a hard on for Randy... is all I can say! no weapons, nothing just alot of meds.. His 4 plants were huge.. It was like 10% over the 999 grams but they weighed dirt, stems, seeds, leaves plus smokeable product

I just want to mention why I want to know if there were any other circumstances because in Ohio I never heard of 3 years for 4 plants. If he had a gun, sold cannabis or other drug or been in trouble before then the sentence could be because of something in his past. If he has never been in trouble I really do want to know how he got such a terrible sentence.

I have looked and the only thing I found was Randy's words on a thread concerning Steve Kubby about how they withheld his medicine when he was in jail before. Randy Brush is a father of 3 ... never been in trouble until his now exwife called drug enforcement and had him arrested on growing those 4 plants on his roof last year..
I gave Randy safe haven in my home as well as a california patient(Steve Hoskins) who also was arrested last year for have small amounts of medical marijuana leaf.. Both these men lost their life as they know it because they are patients and were arrested. neither of these men had records and both were made examples of.

Thank you. I checked out the web site and found some information on his case. Why was this a medical marijuana case when we don't have medical marijuana as a defense in Ohio yet? I am totally confused by this. I would like to see the actual charges and sentence and that would help me put it together a little better but I don't know where to look. I have no idea where Wellsville is in Ohio or any of the names of towns mentioned.

In comment # 36, Tonya gives an extremely detailed account of what happened. She's more involved in this case and knows all the particulars about it. It's just so insane... to be jailed for treating your illnesses with a heaven-sent herb! This poor guy has had his life torn apart for wanting to feel well! I really want to know more about Randy's case. According to NORML's State Law chart he shouldn't have gotten much of a sentence at all. 4 plants wouldn't amount to much in volume. Did he have a good or bad lawyer? We don't have a medical marijuana law in Ohio so just based on the current law he shouldn't have gone to jail at all in my opinion. I don't know anyone that had that small of an amount that has been sent to jail. I looked and looked and can't find an article on his case either. He had much different views as to why schools don't participate in mandatory drug testing."When Walters was on NPR, they quoted him saying some schools were too worried about lawsuits to drug test.Yes, it's time to get smart, Johnny, and start telling the truth about cannabis.You won't have that job forever. Very few people except us here on CNews knows Jerry Sisson. Steve is well know but my burden to help hasn't been for anyone but Jerry and his wife Linda. NPR ran an interesting piece today on drug testing in schools, and the government's push for increased use of mandatory testing. The piece noted that less than 1/2 of 1 percent of all schools use mandatory random drug testing.It was noted that available statistics don't support the value of testing and that the government has, inexplicably, failed to conduct their own legitimate study. There were some good quotes from Students for Sensible Drug Policy and school administrators saying that it makes more sense to drug test only for cause, and reduce drug use in schools through fact-based education.

Randy Brush is a father of 3 kids and a former carpenter who was injured on the job. And yes, Randy is in Ohio. Ohio with a stalled medical marijuana bill, SB 74, introduced in January 2005! If that bill had been passed, Randy would have broken no law by treating his conditions with a medicinal herb. Among the things this legally disabled man (on SSI) has are ischemic heart disease, osteoarthritis, degenerative and discogenic back problems, spinal stenosis, high blood pressure, osteopenia, and depression (just a partial list). It was so obvious to the cops who busted him that he was disabled and NEEDED medical marijuana, that they "left behind a significant portion" of his dried marijuana! (Bless them all for that!)All those that want to {pass a med cannabis bill in Ohio go talk with Dennis, i hope that Montel and Willie and many others will come and support Dennis.

My friend, for many reasons, was and is a "man-on-fire"...big time. Many of you would be familiar with him if I said his name. I know another young woman activist, who, had she just received the shirt FoM is...indeed...very happy to have and so excited about having...would have changed to it immediately and be rearing at the chance to hit the street and let people know about it.She's young and she loves to be young. She is stunningly intelligent and well spoken. She has the spirit of ancient Asian ancestors. She has a magnificent mind, spirit, and soul dwelling in her amazing self.But hey...we do what we can.I thank God for you "fire-brands". You have to "blaze". That's who you are.I still tend to skulk a bit, as far as trusting my fellow man. I've found it safer in the long run.Truly, I care. Truly I've marched. I've carried signs. I've written. I've called. I've asked questions and I've answered questions. I've been accused of stuff I wasn't doing and blamed for things I didn't do...and I've been blessed with amazing Grace. I've donated. 
I've driven with banners against prohibition on my car. But, that's only my arm you see holding that sign on the internet. I've helped. I've been there for some people. But few people...although some...would know me if they saw me. But, I'm not Walmart brave or bold.Besides…the spirit of my beloved grandmother is lurking somewhere in my subconscious about to jump me for making a "scene" should I even think of such a thing.

Hope, #64 You are not a coward for not hanging flyers up at Wal Mart. If you are in a small town it might not be wise. You can still do your thing when the time is right, you know the saying “Timing is Everything”. As long as you stay under the radar, you can inflict more truth when it is called for, and they will never see it coming. Be careful. I kept the flyers
for my personal collection and shared them with some people.I'm enthusiastic. I have a picture, a large framed photograph, of a cannabis activist smoking one for the camera. It's absolutely lovely. It's hanging in my living room right over my computer. Against the ceiling...next fo a collection of mirrors...one shaped like Texas.I have banners, safe access, medicinal cannabis books and more books...like Drug Crazy, Bad Trip...all openly displayed in my living room.I'm just not Wal-Mart enthusiastic, in a small one Walmart town. (They aren't "one horse towns" anymore...they're one Walmart towns or no walmart towns in this part of Texas.)Forgive me. Call me a coward. But that's where I am.My home is my castle...so far. More or less. I can be me here, somewhat, whether "they" like it or not. Wal-mart is definitely a "they" place. I don't want to rile them.I exist...but I prefer not to be famous or worse, infamous.Hang's head.

Recovery Process
FoM. Good to hear you are on the downhill run with your flu bug. It got myself and our family, one at a time, a couple of weeks ago. Strange strain of virus. I find mass quantities of Orange Juice works for me. Also the only thing I can eat while feeling that terrific are sausage patties on whole-wheat toast. OJ, & sausage patties on toast. You have to have something in your system to help fight off the crud.

I tried to get up the nerve to post some flyers on the local Wal-mart bulletin board. They were quite good, made by an enthusiastic activist friend. I tried to visualize it on the security cameras. Imaginative people aren't necessarily paranoid...but they can conjure up dang brilliant and well focused previews of "What if?"....

Try to wipe out some lingering germs
off the light swithches, phones, remotes, handles and faucets...Doorways where people might put their hands. Steering wheels. Leashes. Anything a person touches with their hands or sneezes or coughs or breaths on that someone else might touch.Oh yes and blast the air with a disinfectant of some sort for good measure. Oil of oranges! Kills germs and smells good...but it will destroy plastic...so use something else. Dish soap and water is a great disinfectant. Rag it like Granma used to.I'm so glad you're feeling better.

It happens. Once taking my daughter and her family to visit my son and his family...we all got some sort of hideous virus that they had just started having. Thankfully they had a lot of bathrooms, resting places, and lined wastebaskets.I cary Germ-X with me everywhere and use listerine for the germ killing effect...not the breath effect. So far, this year...so good.It's wonderful to get well again...it's like another second chance at life.

I've wondered at that and tried to research it as well.My spirit is what makes me want to dance or sing. My soul is what actually makes my body do it.I know....I just made that up...but I like it and it kind of makes it look clear to me. Lol. Well...it does.:0)Spirit makes me want to do something or be inclined to it. Soul makes me do it...carry out the wishes of the spirit, that is me. Soul, Body, Spirit. Spirit is the conciousness. They have a soul....I think
The only thing that I know of in the old writings that hints at such things, is when it's mentioned, somewhere in the the collection of the New Testament, that "the spirit of an animal goes into the ground. The spirit of a human goes into the air."No reason they can't be dust in the wind....together.t alBack to the soul. They grieve. How can they grieve if they do not have a soul?They certainly have "spirits". Oh their spirits! I'm pretty sure, somewhat convinced, that this lab I have now is a descendant of the type large, powerful, bold Labrador Retriever type dogs used as sled dogs in northern spaces in days of old. I can see this in him. I think what I see in his face is "Snowy"...very "snowy". I can also see him "mourning" when he thinks no one is noticing. He's thinking about someone else, another time and place...and he's sad about it. He almost cries out and whimpers at these memories sometimes, it seems. It makes him uncomfortable and sad to remember whatever he is remembering. He's not a sad dog...at all. I just see sadness in him sometimes.I also believe that animals, sadly, may pray, or something very like it, on occasion. Some of them do. They pray to us all the time. It would be foolish to say they are not aware of all I'm aware of. They are aware of more than I can be aware of. They hear better. They smell better. They just can't get the words out so well.Who knows? Who can truly say they know? There are clues to what someone else may have known or thought they knew. Animals are important, though...I've figured that much out.Some of them have logic. I had a wonderful beast who learned what "A ---- L ---- P  ----- O",  spelled.Or..maybe I'm imagining this and all of you, and none of this is real.:0)

We need these names and addresses! We do. These people cannot be forgotten. These prisoners need names and faces and stories. They need books written and reporting done. REPORTERS!!!! STORIES!!!! GOOD ones and IMPORTANT ones.Get to WORK!!!! Do SOMETHING!!!REPORT!!!!!!!!!!!!

So Noah knew that the water on the earth's surface had gone down. After he had waited another seven days, he sent out the dove, but she did not return to him again.

 government can hold a midnight hearing to keep a brain dead person on live support, but the sick that are trying to live with bad health, they just kick them in the face and tell THEM to go to jail and HURT. Hello Dr, Frist stick it to the people again... and the only way you can get me off you donkey is get out of office... you will not even write me any more donkey... and I know you read this board and post...

I don't know who Randy Brush is but that sentence seems really harsh. Is he from Ohio? I never heard of 3 years for 4 plants.

Randy Brush
Randy Brush is a father of 3 kids and a former carpenter who was injured on the job. He then learned that he had several serious medical conditions. The pain pills the doctors gave him made him unable to function. At a friend's urging, he tried mmj and it worked! He was able to be a father to his children again. He grew 4 plants to supply himself with medicine. He was narked on and busted. He got 3 years. Right now, he is so depressed that he is refusing to take his medications- or at least that is what the jail is saying! It wouldn't be the first time that medication has been withheld from a prisoner. Please write to Randy and also to the jail to insure that he gets humane treatment (meds on time, proper dosage, etc). Randall Brush is at the COLUMBIANA COUNTY JAIL, 8473 COUNTY HOME ROAD, LISBON, OHIO 44432-9418. Please write to him and his jailers.
