Alaska -- In 1975 the Alaska Supreme Court ruled that the state's constitution affords its residents a right to privacy protecting them from prosecution for possessing small amounts of marijuana in the home. To this day that interpretation stands as the law of the land, with privacy implications extending well beyond the drug war.In 2006, Alaska is trying to get ahead of a health and safety scourge - methamphetamine manufacturing and sales - that has ravaged parts of the Lower 48 and increasingly threatens Alaskans.
What do the two have in common? Nothing, which is why lawmakers now reviewing a proposal to crack down on both methamphetamine cookers and marijuana possessors should rip the bill in two.On Wednesday the Alaska House rejected a combined drug-enforcement measure approved by the Senate, and some representatives objected to proponents bypassing their chamber's vetting procedures by lumping the drugs together. Some also objected to removal of a log-book requirement that would allow police to track people who buy meth's core ingredients over the counter from pharmacists.The bill approved by the Senate also would criminalize home possession of 4 ounces of marijuana, the legislated amount previously considered small enough to be covered by the court precedent.The Senate legislation now faces conference negotiations with the House, in which it should be split up and the marijuana provisions dropped from further consideration. Where in-home possession of marijuana is essentially a personal decision, right or wrong, methamphetamine manufacture and use present both environmental and public safety dangers. Meth users pose a danger to many around them, not least police officers, while meth cookers create health and safety hazards for their neighbors. Merging an unconstitutional anti-marijuana measure with a necessary attack on meth-making amounts to a sneak attack in the name of election-year pandering. The marijuana ban deserves its own examination, through the complete legislative process, and then it deserves to be dumped as a waste of state effort and money.The bill's proponents, including the Murkowski administration and its Department of Law, reject the Supreme Court's precedent and want another day in court. With this legislation they are trying to make a case that today's marijuana is not your 1975 hippie's marijuana, but instead is much more potent. They note that laws against cocaine possession have survived privacy-based challenges because cocaine can be a killer, and argue that today's marijuana is more menacing than yesterday's.But the Alaska Supreme Court has declined administration appeals to review the issue, and as recently as 2004 the Alaska Court of Appeals rejected the state's claim that it could execute search warrants for small amounts of marijuana. Nothing is new here except the year and the election cycle. Passage of the Senate's so-called "methi-juana" bill would merely ensure that police would invade someone's privacy and that the state would follow up by prosecuting that offender only to be shot down once more for violating the Alaska Constitution.Meth and marijuana present vastly different physical, social and legal issues. The Canadian officials
that said Steve Kubby wouldn't be arrested and inprisoned without his livesaving medicine were wrong. I sure hope they are aware of what is happening to Steve and his family. Surely Michelle and the girls still have friends in California that will let them stay with them until they can find a home of some sort.It looks to me like the Canadian officials ought to be raising some sort of heat about what is being done to Steve and his family.Even after his sentence is served, they won't be able to return to Canada where they had more peace, will they?

This situation is getting more bizarre an worrisome every day that the owner doesn't say anything to the community. It may mean that he is being held without bail, but I seriously doubt that, with what I know about the Canadian system. I sure hope he got out today or is getting out tomorrow. Marc Emery has been stating info about it on his site, but we have no way to know for sure if it is true or accurate. We need to hear from the man himself (whose name is probably Richard). It's hard to believe that he hasn't had any time with his attorney yet and asked him to issue a communique to all the people whose safety his servers may be keeping safe or are about to compromise. Thousands of people need some answers.

They knew they would lose in the 9th Circuit, so they refiled in state court. This is dumb, because they're now in the position of asking the state to overrule itself by interpreting federal law, but dumb strategy does not change the basic arguable case.With respect to NORML, though, I just cannot make heads or tails. You cannot sue someone on the basis that they will sue you if you don't sue them first. That doesn't even pass the laugh test. I mean, yeah, technically anyone can sue anyone any time for any reason, regardless of whether or not the case has any merit at all. But if you don't have a reasonable cause of action you're going to get tossed out of court and probably assessed fees for vexatious litigation.I want to assume that the county isn't completely incompetent, even if the managers are, they presumably have counsel who would tell them that there is no case to be made for pre-emptively suing NORML unless there is some basis to such a suit. I just cannot figure out what it could possibly be.

I think they will probably have a great Olympics. They should get lots of people from all around the world and many from the western states of the USA. I haven't been out of the United States so I don't know the world views issues. I've been in many states but that's as far as I've traveled. I don't know of any country as outspoken about drug related issues legal or illegal accept maybe Amsterdam but there again I have no way of knowing. It's just what I think.

Vancouver is a fantastic place! Culture, great outdoor lifestyle, the mountains, the ocean. Beautiful!They will host a great Olympics.I really think the US generally stands more in cultural contrast with much of the world than Vancouver does. I feel that Vancouver is quite cosmopolitan.

We are all just North America now. We are global and we work with Canada. Canada has water, oil, beef, lumber and we have goods that they want and need. They need to clean up Vancouver for the Olympics. They don't want to have people from other countries come to Canada and wonder why they are so different. I guess I look at an issue like this in ways that others might not.

I did not want to wake up to this headline on CannabisCulture this morning:Overgrow.com, Cannabisworld.com, Heaven's Stairway Seed Company, and Eurohemp.com Shut Down and Servers Seized by Canadian Police.  Now it appears Heaven's Stairway Seeds (hempqc.com), Cannabisworld.com, Overgrow.com, Eurohemp.com have been shut down and the owners arrested in Canada; all their web properties seized, including the physical servers that held massive databases on thousands of growers, and tens of thousands of photographs of cannabis plants. Seed companies by the dozens used both Overgrow.com and Cannabisworld.com as a main trading ground. Over 40 seed companies had customer service interactive forums on these sites.  All the information held on those servers is now in the hands of police. It is not known what charges have been laid nor against whom. That police have not boasted about this seizure means the investigation is continuing, before any affected parties can react.

I did post news on OG when they first were online for about 7 months but I couldn't handle the extra work it made back then. I don't know who RC is. I always thought RC was Richard Cowan. I'm glad that this paper finally decided to write an editorial against this. What took so long? I can only hope it was because they were waiting for the Sunday edition. Though if they had passed this bill straight through, this editorial would have been too little too late.
