Laura Kriho is a nationally known activist who became the first juror in over 200 years to be arrested for voting her conscience. Enclosed is her letter to the editors of the newspapers in our home area.

The Kubbys have recently issued a challenge to the District Attorney's office: either release the Kubbys' computers that had been seized during their arrest so the Kubbys can examine the hard drives for evidence of tampering or drop the charges against the Kubbys. Either of these alternatives would be a step towards justice in the Kubby case, therefore neither is likely to happen. There is no justice for medical cannabis patients in Placer County, at least not from the prosecutors or judges. Proposition 215, designed to protect patients like the Kubbys, is the law of the land and California. But when police and prosecutors and judges ignore this law and persecute patients, where do patients find justice? The answer is: in the jury box. The Kubbys will have a trial by jury, which means that twelve Placer County citizens will have the power to do justice in the Kubby case by acquitting them of all charges. The jury has this power of acquittal, sometimes referred to as jury "nullification" of unjust laws or vindictive prosecutions. Most jurors do not know they have this power. The courts will not tell you. In fact, judges often mislead jurors into thinking that they have to "follow the law, whether they agree with it or not." Nothing could be further from the truth. The jury was designed over a thousand years ago to protect citizens from a repressive government. Never has there been more need for jury protection than in the Kubby case. Thomas Jefferson, our third president, said, "I consider trial by jury as the only anchor yet imagined by man by which a government can be held to the principles of its constitution." John Adams, our second president, said about jurors, "It is not only his right, but his duty ... to find the verdict according to his own best understanding, judgement, and conscience, though in direct opposition to the direction of the court." I urge all potential Placer County jurors to inform themselves about the duty of jurors to resist government oppression. Only when jurors have been fully-informed of their powers can we expect to see any justice for medical marijuana patients in Placer County.
