Friends, Have the police been caught red-handed, altering and falsifying evidence on our computers? The answer is locked up in the computer hard drives. 
Wed. 7/14/99 These serious allegations can be easily proved or disproved by examining the internal architecture of our computer hard drives. However, the Placer County District Attorney seems determined to prevent us from examining those drives and even persuaded a judge to deny us access. Why? What are they hiding? For some time now we have been receiving information about efforts by the police to punish me for my role in Prop. 215 and to silence my support for medical marijuana. A good example of how credible this information has been is the infamous tip about the "green Jeep Cherokee with tinted windows." Not only did we know within a couple of days of the start of the investigation that we were under surveillance, we were later advised to look for a green Jeep which was being used to spy on us. We eventually identified that vehicle and kept a fearful eye on it. Last September, I shared some of this information with Peter King, a well-known columnist whose work appears in many of California's top newspapers. Later in a column he penned this February (after our arrest), Peter King recalled my private comments to him from the previous September: "Now, with the interview winding down, the otherwise free-wheeling politician asked to go off the record. Kubby confided he was concerned about drug police payback. He had received a tip: A stakeout of his Lake Tahoe residence was under way. Specifically, he had been warned to watch out for a green Jeep Cherokee with tinted windows. He wasn't sure whether to believe this, and he did not want to come across in a campaign interview as a caricature of pot-induced paranoia." We were told that our computers have been tampered with and that false and incriminating information has been inserted into those drives. In addition, we have learned through our technical advisors that this highly inflammatory charge can be easily proved or disproved by examining the internal directories in the drives themselves which contain a perfect historical record of all modifications. Frankly, I was skeptical that the police would go so far as to manufacture evidence. Still, it seemed reasonable to go to the court and ask for our hard drives back so we could verify if sabotage had really occurred. All of us received a rude awakening when the prosecution fired back a 50-page motion to deny us access to our computers. From that point on, we couldn't help but suspect that our latest tip was deadly accurate. On Tuesday, July 13, 1999, our attorneys asked Auburn Court Judge McLeheny to allow us to examine the hard drives for "sabotage." In addition, we asked for time to examine a CD copy of our hard drives which was supposed to be delivered to us in February, but was not delivered until just a few days ago. In court, the prosecution never even told the judge why they were refusing to turn over the computers. Nevertheless, Judge McLeheny denied both our motions, refusing to give any reason for doing so. The decision by Judge McLeheny will force us into a trial starting next Tuesday, July 20, 1999. Six months of intensive investigation of our computer records will be used against us and we will have no time to review the CD copy of files the prosecution alleges belongs to us. No trial can possibly be fair or just under such circumstances. Therefore, I am issuing the following challenge to the prosecution: EITHER PRODUCE THE COMPUTERS SO THE HARD DRIVES CAN BE ANALYZED FOR SABOTOAGE BY OUR EXPERTS OR DROP THE CASE. In addition, I am asking our supporters to write letters to the editors to help publicize this challenge. A list of our local papers appears at the end of this letter. Please write a letter or email on our behalf and demand that Placer County either hand over our computers or drop the case.
