California to Legalize Sales of MMJ Statewide?

SB 848 will allow marijuana sales in California. Measure makes California First State to challenge federal law directly, there’s only one catch: it’s a secret.
California’s State Assembly is about to decriminalize the sales of marijuana between individuals if they register with the state. But the text of SB 848 (Vasconcellos-D, San Jose) is still secret pending approval of California Attorney General Bill Lockyer. SB 848 will allow sales of medical marijuana by granting registered persons immunity to specific State Health & Safety Codes such as: 11366 (Maintaining a place for selling, giving away, or using any controlled substance), or 11570 (Creating a nuisance by dealing drugs from a house), or 11360 (Sales). If the State Supreme Court upholds the new law, only the federal government could prosecute these cases.The Bill’s final public hearing will be this Tuesday, July 13th at 1:30 PM in Assembly Health Committee. SB 848 has already passed the State Senate (two committees and a floor vote) as an essentially blank document, just a few paragraphs of rhetoric. "When the final report is really issued, it will be in a formal setting after getting all members on board and all the i's dotted and the t's crossed," Said Nathan Barankin of Mr. Lockyer's office. "Mr. Lockyer wants a proposal that will work not just in concept but in practice," he said. "That's why he's working so hard to make sure law enforcement organizations can support the final version."Some patients however, fear that this bill has become a police effort to control sales instead of a sincere effort at protecting them. They feel the cops may have had too much input into the new law while patient involvement on the Task Force was marginal.Proposition 215’s author Dennis Peron has proposed a simple four-word addition to the State law against selling pot (HSC 11360): "Except for medical purposes." The Lockyer Task Force proposal is 16 pages and top secret. Peron’s Bill still needs an author.The 16 page "Recommendations of the Lockyer Task Force" will become SB 848.
