SUSANVILLE -- Former Lassen College student Paul Berry III is scheduled for two separate jury trials after he rejected a plea agreement Wednesdayoffered by the Lassen County District Attorney's Office.
Berry, a St. Louis resident who entered the two-year college as a wrestler, faces a felony drug trafficking charge involving a half-gram of marijuana.He also faces charges of felony theft and misdemeanor filing a false report that stem from an unrelated incident.His trials are scheduled to begin Aug. 19 and Sept. 1.In May, a Lassen County jury convicted Berry of buying $20 worth of marijuana from an acquaintance for an undercover agent.The jury split over a second similar charge.Instead of refiling the second case, District Attorney Robert Burns offered Berry a six-month county jail sentence and a $100 fine in exchange for pleading guilty to misdemeanor possession of marijuana and filing a false report."He just couldn't do the plea because he isn't guilty," said Richard Murphy, Berry's Susanville attorney.Berry was one of 20 Lassen college and high school students arrested in December after an undercover operation. The others plea-bargained settlements but Berry opted for a jury trial. This story did not contain the information that was in the first article a couple of months back.. This college student will lose his scholorship to college if he is convicted of this $20 sale. This undercover officer, Cherokee Miranda, is the same officer that was as the highschool in our town. She is now being sued for doing the drugs with the students she turned in and also for having sex with a minor.My daughters knew of this girl and apparently it was common knowledge that she did the drugs with the kids. Destroying young lives is not a solution to any drug "war". Kids will experiment with many substances when they are young but to take a students career away for such a minor offense is criminal to me.
