City Takes Up Medipot Issue

City of Davis planners and officials are grappling with an issue popping up in cities statewide - regulation of medical marijuana dispensaries.The Davis City Council unanimously set in place Monday morning a 45-day moratorium on such dispensaries. The moratorium establishes an interim review process while city planners iron out zoning rules for the facilities.
During the moratorium, dispensaries would need a conditional use permit from the city.A few weeks ago, someone approached the Davis Community Development Department, inquiring about the city's zoning rules. City planners reviewed codes and found that they are not clear on the matter."Our rules were kind of vague about how to deal with these kinds of things," department director Bill Emlen said. "By establishing this (moratorium), it doesn't prohibit them, but it establishes a process that would have to be followed - and a discretionary process, at that - for the city to evaluate a proposed facility in a specific location."No applications for such a facility have been filed with the city.As the rules stand now, dispensaries might be permissible in any zone allowing retailers, drug stores or medical facilities, according to a city report.The moratorium is in effect until Sept. 17, unless it is extended by the City Council.On Sept. 14, the council will review options for regulating or banning the dispensaries.Davis is among several California cities wrestling with the issue. According to the city of Davis, Rocklin and several other cities have prohibited the dispensaries, and Roseville, Oakland and some Southern California cities have regulated them.Dixon officials are in a similar position.
