San Francisco -- A judge here refused on Thursday to block a threatened drug-dealing prosecution against Dr. Molly Fry, who recommended marijuana to patients at a clinic in Cool and may have sold them pot-growing kits."If somebody's innocent, they get vindicated at trial," U.S. District Judge William Alsup told Fry, who could be charged in federal court in Sacramento.

Madera - AP -- A Madera County judge will decide this month whether the city of Chowchilla should face punishment for not returning medical marijuana to its owner.Forty-three-year-old Michael Celli of Chowchilla wants 48-hundred dollars from the city.He says it's illegally keeping marijuana confiscated from his car during a police stop last year.Celli says he's a medical marijuana patient who bought the pot legally from an Oakland co-op.The case involves a discrepancy between state law -- which allows possession of medical marijuana if someone has a doctor's prescription -- and federal law.Police officials cited federal law in their decision to keep the marijuana.Copyright 2004 Associated Press
