A Letter from Steve Kubby!

FEEDBACK: LOCKYER/VASCONCELLOS MEDICAL POT BILL (SB 848) It's been less than 24 hours since I wrote about SB 848 and I've already received nearly fifty emails.
Many people want to know where they can find a copy of SB 848, but since I'm not in the loop, my source has been Dennis Peron's group at:http://www.marijuana.org/PRLockyRecsONE.html I should point out that California NORML support SB 848 and stresses that SB 848 is a voluntary program. Also, I've been cautioned that the Peron site is inaccurate and contains false information. Still, it's all there is right now as a source of information. People also want to know what they can do. The fact remains that SB 848 says nothing about punishing rogue police, D.A.s or judges who refuse to obey Prop. 215 -- which means that this bill is worthless. Witness the first Oregon patient who paid for a medical marijuana card and then was denied use because she was on probation. Pity the poor patients who must choose between fear and betrayal. Who is going to finally stand up and do something to protect the sick, disabled and dying who have enough difficulty just staying alive? Not any of our elected officials apparently. Personally, I think winning our court case will have far more impact than anything the politicians do. Our case is strong, the police have behaved badly and the media is really beginning to take notice. Even Lockyer has privately admitted to our friends that our case could have a big effect. So we think full steam ahead on the court trial is still the best course for us and our supporters. Judging from my heavy traffic on this topic, SB 848 is probably going to consume major bandwidth in the days to come. Below is a selection of the comments which I found most valuable:From: Dr. John Beresford , Psychiatrist "The most amazing thing is Lockyer's craven comment that no legislation is going to work if it does not have the cooperation of 'law enforcement.' How much closer to a definition of a police state can you get than that?"From: Jon Gettman , Currently leading the fight to force the DEA to reschedule marijuana. The Rescheduling Petition is on-line at:http://www.norml.org/legal/petition.shtml "The Lockyer Task Force proposal looks to me like it is designed to control an addictive, dangerous drug. Supporters of Proposition 215 never acknowledged that marijuana was such a drug and to the extent that they may oppose the Lockyer Task Force proposals they will do so in complete consistency with their election year positions. Proposed legislation or initiatives that concede that marijuana is an addictive, dangerous drug by accepting controls that are designed for addictive, dangerous drugs provide no such foundation for challenging this sort of legislation." From: Dale Gieringer , Chairman, California NORML "You are misinformed about the the provisions of Lockyer's bill. There are NO new felony provisions whatsoever. The provision you are referring to says that having an identification card does not protect patients from arrest (for misdemeanor possession) if they are smoking - on public property - within 1,000 feet of a school. There is nothing to compel officers to arrest folks if they violate this provision, and courts could still dismiss the charges under 215." From: Robert Raich , Lockyer Task Force Member, creator of the Oakland Guidelines "There are things in the bill that are not as good as we would like. (Such is the nature of compromise.) They can be opposed and discussed in a rational, informed manner." From: Laura Kriho , National FIJA activist "I still think the idea of an independent citizens commission is a good idea for CA. Much easier to lobby 7-9 committee members than it is to deal with the whole state legislature. Of course, getting anyone to carry it might be hard, seeing as it takes power away from the legislature. "The actual proposal for the California Therapeutic Marijuana Commission is at:http://www.levellers.org/caprop.htmFrom: Mark F. Murphy , Software Developer, Libertarian "215 is the law of the land and has *not* been overturned. What's required is for our law enforcement, indeed our highest law enforcer in the state, to comply with 215 immediately. I'd sure like to bring them up on charges for not doing so." From: Gail Lightfoot former Chair, Calif. Libertarian Party "Now is the time for weekly Press Releases covering the points you have made on SB 848. Only by bombarding the media with information in bite sized pieces do we stand a chance of getting articles and Letters to the Editor printed, raising public awareness and having the voters demand Prop 215 be upheld as it stands."From: J. R. Graham , On-line activist "Hold the line. Don't settle for half a right..." From: John McCready , Libertarian "You don't suppose that the REAL purpose of SB 848 is to make things so 'bureaucratically impossible' FOR medical-marijuana patients that they will just "give up" and not use?" Thanks For The Link!
Thank You Jean! I have the greatest respect for Dennis Peron and I was concerned about posting this but it is the way it is and I sure hope all the medical marijuana activist's get their heads together and any strife is put aside. We can only win when everyone works in harmony I believe!
