Legalization -- Small amounts would be OK for personal use; two other proposals expected.A proposal to legalize marijuana use in private by people older than 21 has become the first initiative approved for the 2004 general election ballot. Lt. Gov. Loren Leman, a public opponent of legalization, announced Tuesday that he has certified the 28,783 petition signatures required to place the initiative before voters.
With less than a week left before the 2004 initiative deadline, only two of six petitions still outstanding are expected to show up on time with the requisite number of signatures, said Tom Godkin, a supervisor in the Division of Elections. To make it onto the Nov. 2 ballot, signature booklets must be at the Division of Elections before the gavel comes down on the opening of the new legislative session, which is 10 a.m. next Monday.Sponsors of an initiative to outlaw bear baiting and one mandating an election to fill U.S. Senate vacancies have advised the division they will be bringing in their signature booklets before then, Godkin said.Nearly 30 years after the state Supreme Court first concluded that Alaskans have a right to possess small amounts of marijuana in their homes for personal use, the recreational drug that gained wide acceptance in the 1960s is still provoking challenges in court and on the ballot. Marijuana Legalization Initiative Certified for 2004 General Election 
 
January 13, 2003Lieutenant Governor Loren Leman today notified sponsors of the initiative petition 01MRNA, "An Act to Decriminalize and Regulate Cannabis (Hemp Including Marijuana)" that their initiative has been certified for placement on the November 2, 2004 General Election ballot. The Lieutenant Governor originally denied certification of the petition in January 2003 because of a lack of qualified signatures. One hundred ninety-four signature booklets could not be verified by the Division of Elections because of reporting deficiencies. Gathering and receipt of the signatures took place under former Lieutenant Governor, Fran Ulmer, Leman’s predecessor. On September 23, 2003, Anchorage Superior Court Judge John Suddock ordered that 168 of the booklets be counted anyway, despite the reporting deficiencies. Sponsors were notified on November 13 that under the Court order their petition had the required 28,783 signatures to qualify for the ballot. For additional information, please contact

I quick checked out the article and I wanted to say something. Many people who have problems and need help have probably used Cannabis but more then likely other drugs and alcohol are to blame. Because someone uses Cannabis doesn't mean they will wind up with mental health problems. Locking up people because some folks are having mental health issues is not a good mental health practice and they hopefully know it. I hope!

O'reilly is in favor of decriminalizing pot.That says it all my man...People who are familiar with "Oh Really" know that he is as CONSERVATIVE as can be. He's for censoring all MTV music to "our kids" and in is the biggest liberal basher around..............and he says he'd decriminalize it. It took me a while to deeply think about and process this signal. When O'reilly says he'd decriminalize, and you KNOW most liberals favor pot emancipation. So I just hope this is a good signal of what to look forward to in the election, ballot

It means the people will vote for legalization. It has a very good chance of passing and would be the side I would bet on. US prohibition relies on a non-penatrable defensive line. We have breach of a kind on national scales. The federal power grab that ignored the 10th amendment and held the federal purse over the states could see a breach here. If the iniative passes there is a breach of the defense of total prohibition. If this would lead to a 10th amendment challenge that called up the absurdity of federal power over all things because of a commerce clause and sensibility prevails, it would be the beginning of the end.It is a very big deal. It might well be the story of the year in 2004. It will mean for almost certain that California will be embarassed not to have iniative in 2006 and by then, the outcry would be so great that every state with iniatives will have well-chosen words for freedom on an iniative.Cannabis Prohibition is an obvious wrong. On November 2nd, the news that the defense has been breached will lead to a grabbing of the pitchforks and the wrong and the bullshit will be over.

Under the initiative, marijuana "could be regulated like alcohol or tobacco." The initiative permits laws limiting marijuana use in public or to protect public safety. It leaves in place bans against use by minors.

We need to free the weed. 
Now there is an idea for a t-shirt- We need to free the weed.I have blanks about the current situation and the new iniative. At least we have one of the states with iniatives having a ballot issue approved. It is nice to know it is a done deal and the voters will have a debate and have their say.I wondered about the current situation that says a person can possess 4 ounces in their home and they are letting them grow 20 plants. Does in the home mean exactly that or can you have a greenhouse or can you grow outside? I especially wonder if it applies to rental situations and in particular to a bread and breakfast situation where the owner might have 20 plants for the house specialty of ganja gumbo. The present law is a law of privacy and not a law of regulation. I just wonder what are the implications of the small window the Supreme Court granted.For example, could a person that had a house with a rental house next to it have 20 plants and rent the house to a teacher on summer vacation and move some plants over so that they might be harvested within a few months and of course a mature plant upon arrival.I would ask on the Juneau Empire messageboard, but I have never been approved.The iniative that passed in 1990 won with 54% of the vote. There I wonder how many even voted in the mid-term elections. This year will be a presidential election with Alaska probably being a Bush state. They must not read the Internet, but I take it they know the need to free the weed. I would think that the iniative was worded wisely after the loss last time. I have to believe it will pass.

If Im not mistaken, this initiative requires the state to set up a regulated system for its sale and distribution.

As someone already brought up...
 I thought the court decision about 2 month's ago already made it legal in Alaska to have up to 4 ounces.Can someone explain the difference between the court's decision and this ballot question?Use smoke signals.
