San Francisco -- Four Placer County sheriff's deputies must answer to a lawsuit accusing them of violating the civil rights of a woman and child during a 1999 marijuana raid of their Citrus Heights home, a federal appeals court ruled Friday. The judges said the undisputed facts of the civil suit filed by the family of Chris Miller showed the deputies pointed guns at Miller's wife and 10-year-old daughter for 10 to 15 minutes.
Pointing guns at a child who posed no threat was a clear violation of the law against excessive force, said the 9th U.S. Circuit Court of Appeals in a unanimous decision by Chief Judge Mary Schroeder of Phoenix and Judges Diarmuid O'Scannlain of Portland and Wallace Tashima of Pasadena.Miller and his wife, Penny Miller, were arrested in the raid. Charges were dropped, however, after an investigation showed Miller may have been eligible to grow his pot -- five plants and a dozen clones -- under Proposition 215, California's medical marijuana initiative. He had a doctor's written recommendation to use the drug for chronic pain and muscle spasms, results of a series of car and motorcycle accidents. Eight months after the raid, the county returned Miller's marijuana.Snipped: Complete Article: http://www.sacbee.com/content/community_news/placer/story/8039144p-8974816c.htmlSource: Sacramento Bee (CA)Author: Claire Cooper -- Bee Legal Affairs WriterPublished: Saturday, January 3, 2004Copyright: 2004 The Sacramento BeeContact: opinion sacbee.comWebsite: http://www.sacbee.com/Medicinal Cannabis Research Linkshttp://freedomtoexhale.com/research.htmCannabisNews Medical Marijuana Archiveshttp://cannabisnews.com/news/list/medical.shtml

With regards to the article
Recall the recent Goose Creek debacle, with police waving loaded, safety-off service automatics in the faces of children - when they weren't pointed at the backs of their heads after they'd been thrown to the floor and plastic-cuffed.Some of you may be wondering why they'd do this; why aim guns at little kids to begin with? I can tell you why.Back in the 1980's, a very realistic training method called FATS was developed. Here's their website: http://www.fatsinc.com/It was a screen with a type of movie projector *behind* it. Your weapon was loaded with extreme low velocity rounds tipped with wax. You'd stand in front of the screen while a scenario played out courtesy of actors who, if they were the bad guys, would 'shoot' at you in the video. You had only seconds to fire at their images on the screen. If you hit them, the scenario would stop immediately. No pictures of moaning wounded laying on the ground, bleeding and dying. The situation could be deadly serious (a bank robbery or hostage situation) or damn' silly (coming around a corner to see a trenchcoat-clad perv flashing you). One 'run' was especially nerve-wracking: a little kid would be smiling and laughing...and drawing down on you with a pistol. You had only seconds to fire your weapon...JUST AS YOU'D HAVE IN REAL LIFE. And guess what? Sometimes the kiddie's gun was 'real', and if you hesitated in blowing him away, you were 'dead'.This is what is being used nation-wide to teach police how to gauge 'shoot-don't shoot'And yes, dear readers, I was pretty damn good at it. Except for the kid scenario. I always blew that one. Because I had the very natural mental gear-jam, hoping the 'gun' in the kid's hand was a toy...and getting told I was 'dead' for hesitating. You can imagine now what happens when you run through that scenario again and again: the cops' reluctance to shoot gets worn down over time. Eventually, they start 'shooting', reflexively. "Better safe than sorry" takes on a whole new meaning...and sickening twist. And most 'civilians' wonder why this happens? Now you know...

You would think it would be for sale somewhere
I wonder if Apple has Keith's song on their 99 cent menu. Bonnie Raitt has a song called "For What It's Worth" from this link- http://www.writersact.com/tunes/Raitt-SF-Happening.mp3 - according to this thread- http://www.democraticunderground.com/discuss/duboard.php?az=show_topic&forum=105&topic_id=605483This thread has an alternate website for the event and maybe it will be helpful in finding an archive- http://www.democraticunderground.com/discuss/duboard.php?az=show_topic&forum=132&topic_id=58738

A friend mentioned that song to us but I had never heard of it. Maybe they'll make a dvd of the concert and sell it.

"I'm Never Smoking Weed With Willie Again"
That is the name of the song Toby Keith wrote for the peace gathering in Texas. He sang it and they talk about it and Willie in another thread at DU- http://www.democraticunderground.com/discuss/duboard.php?az=show_topic&forum=105&topic_id=605569

Like, bummer, dude
I have dial-up and wish they had a way just to get voice, because with video there is something not worth messing with. Evidently, Willie sang his song and this thread at DU tells about it- http://www.democraticunderground.com/discuss/duboard.php?az=show_topic&forum=105&topic_id=605724

You could be right about it not being ready yet. I hope if it wasn't ready that people who went to the concert aren't upset. I don't know if they expected the song to be sung or not. I was under the impression it was being premiered at the benefit concert though.

Hey FoM maybe he is not finished and will add--------At birth weve been taught that Hemp is no good.
While in other countrys it's well understood Respect this Plant or you are up to no good.com on E i know you can write a good peice for us in this song.http://www.statesman.com/metrostate/content/metro/1203/1231willie_song.htmlWillie Nelson, who has endorsed Dennis Kucinich for President, and who will
lead a fundraising concert for Kucinich's campaign in Austin, Texas, on Jan.
3, 2004, wrote a new song on Christmas that he will perform in public for
the first time at the Austin concert. There's so many things going on in the world
Babies dying
Mothers crying
How much oil is one human life worth
And what ever happened to peace on earthWe believe everything that they tell us
They're gonna' kill us
So we gotta' kill them first
But I remember a commandment
Thou shall not kill
How much is that soldier's life worth
And whatever happened to peace on earth(Bridge)And the bewildered herd is still believing
Everything we've been told from our birth
Hell they won't lie to me
Not on my own damn TV
But how much is a liar's word worth
And whatever happened to peace on earthSo I guess it's just
Do unto others before they do it to you
Let's just kill em' all and let God sort em' out
Is this what God wants us to do(Repeat Bridge)And the bewildered herd is still believing
Everything we've been told from our birth
Hell they won't lie to me
Not on my own damn TV
But how much is a liar's word worth
And whatever happened to peace on earthNow you probably won't hear this on your radio
Probably not on your local TV
But if there's a time, and if you're ever so inclined
You can always hear it from me
How much is one picker's word worth
And whatever happened to peace on earthBut don't confuse caring for weakness
You can't put that label on me
The truth is my weapon of mass protection
And I believe truth sets you free(Bridge)And the bewildered herd is still believing
Everything we've been told from our birth
Hell they won't lie to me
Not on my own damn TV
But how much is a liar's word worth
And whatever happened to peace on earth

They said that Willie didn't have the song just the lyrics to his new song and then the rain made my satellite cut out. How can that be? I hope I missed something when my satellite went flaky for a minute.http://www.news8austin.com/content/headlines/?ArID=93992&SecID=2

I went and read about the player and it might work but I get nervous thinking about downloading it knowing that I had trouble when I was trying to get Farm Aid. Hopefully it will be archived on Kucinich's site and won't require that particular player.

What kind of a message are cops sending kids?
When I was ten I ran away from home and was picked up by the police late in the evening. They called my parents and kept me in the staff room till they arrived. I grew up in a working class neighbourhood, but had never heard swearing like I heard that night. Just casual cop talk. When I was thirteen, a group of us were loitering one evening within sight of our houses. A car pulled up with two regular looking guys in it. One ordered us over to the car. I looked up and asked innocently, "What for?" This bully walked over to me, picked me up, and threw me about ten feet through the air. That was almost fifty years ago, but I've never forgotten. Thanks for those links on the development of modern policing, kaptinemo.

http://monthlyreview.org/1203williams.htm And the article by Wendy McElroy, EJ.http://www.foxnews.com/story/0,2933,106899,00.htmlI think it was William Burroughs who said crime can't exist without cops. Do they really spend more than half their time on cannabis persecution?
