California’s "Top-Cop" is obfuscating the state’s medical marijuana law, prosecuting it’s author, and misleading the electorate. Why?
In Bill Lockyer’s first six months as California’s Attorney General his commitment to enforcing the Compassionate Use Act of 1996 has become increasingly questionable. While Lockyer gives lip service to Proposition 215 his office is still: Issuing verbatim the same insane medical marijuana guidelines to state law enforcement that were drafted under Dan Lungren. Prosecuting Proposition 215’s author, Dennis Peron for selling marijuana to sick and dying people three years ago, before his initiative legalized cultivation, possession, and transportation of marijuana for medical purposes throughout California by anyone with a doctor’s approval or their assigned caregiver. Alleging publicly that Proposition 215 hasn’t been implemented, perhaps to excuse his own foot dragging. California Constitution Article 2 Sec. 10. (a) "An initiative statute or referendum approved by a majority of votes thereon takes effect the day after the election unless the measure provides otherwise." Alleging publicly that "federal law is absolute" despite the California Supreme Court’s November 5th, 1998 ruling that state cops can’t enforce federal marijuana laws in California. The Court ordered the California Highway Patrol to distribute marijuana in violation of federal law by returning a half-pound of medical cannabis to a Mendocino patient. Mr. Lockyer is overlooking both the legal weight of the medical necessity doctrine (the need to break a law to save a life) and the growing number of federal judges who respect California’s medical marijuana law. While showing promise at first by convening a distribution task force the composition of the group (mostly law enforcement and pot dealers) and their inability to draft meaningful legislation is eroding Mr. Lockyer’s and Mr. Vasconcellos’ credibility vis-à-vis the state’s 250,000+ medical marijuana patients. Several members of the task force are openly defying state law by either selling marijuana commercially or allowing it to be sold locally (thus the nickname: Cops and Robbers Job Preservation Task Force). The recommendation of this not so credible task force: new attacks on patients that target their civil rights such as attempting to replace Prop. 215’s "oral recommendation or approval" with a "voluntary patient registry." (And if you don’t volunteer, you get busted!) And here's the cherry on the cake: medical pot dealers who support the patient registry will be allowed to deal but if you sell medical marijuana and don't give up your civil rights voluntarily, You Get Busted!! As we might have expected from an entrenched politician, Mr. Lockyer somehow seems to believe that the Federal government has the final say in everything. He, as well as others, needs to understand that the U.S. Constitution gives states more power than the Feds. The Constitution was intended to keep the Federal government from getting out of control (much as it is now, due the fact that we have ignored our beloved Constitution) by giving the citizens of each state absolute authority over any issue not handed to the Federal government. When the citizens of this nation finally understand this (and it seems that more of them do), then we will have a revolution unlike any that has ever been seen. If more initiatives like prop. 215, and others continue to pass, we will effectively limit the power of the D.C. politicians, and begin to see the true liberty of our forefathers. I pray it is so.

We Will Win!
It is so scary to buck the establishment! Fear of reprisals will stop the best well intended person from standing on their principles! I am ashamed that we in this country have become so behind other countries, still hanging on to legislating personal morality, but I feel the tides are changing.Day by day hope comes once more. Lockyer does not have the courage to stand up to the Feds and he is intimidated by MacCaffrey and company. Now he is only giving lip service to prop 215.
