A man caught in the clash of state versus federal drug laws told News 4's Brian Maass that he couldn't believe federal agents raided his home for three marijuana plants he'd grown for medicinal use.Donald Nord, 57, has a state permit to use marijuana to relieve chronic pain from cancer and diabetes. Federal agents, acting on information that Nord was growing marijuana, got a search warrant and found three plants and growing equipment.
The agents confiscated it, and Nord was given a ticket to appear in county court in November. The case was thrown out and, on Monday, the county judge ordered the Drug Enforcement Administration to return the plants and the equipment. The DEA says it won't give them back willingly."I don't understand why the state says I can but the federal government says I can't," Nord told News 4.State law allows medicinal users, with the recommendation of a doctor, to go into a registry of those permitted to smoke, grow or otherwise acquire marijuana. Federal law prohibits all possession of marijuana. The judge gave the DEA 21 days to return Nord's property.Jeff Dorschner, spokesman for the Colorado U.S. attorney's office, said staff will review the county judge's order for the return of the marijuana.Source: Denver Rocky Mountain News (CO)Published: December 11, 2003Copyright: 2003 Denver Publishing Co.Contact: letters denver-rmn.com Website: http://www.rockymountainnews.com/Related Articles:Pot Sparks Showdown With Feds http://cannabisnews.com/news/thread17950.shtmlJudge: Return Marijuana http://cannabisnews.com/news/thread17940.shtmlMedicinal Marijuana Conflict http://cannabisnews.com/news/thread17927.shtml Judge: Return Marijuana http://cannabisnews.com/news/thread17940.shtml

117 Canadian plants legal; 3 US plants illegal

He began smoking marijuana in the 1980s to control his symptoms and now smokes between a half ounce and an ounce of pot a day.'It’s an unbelievable amount of pot,' said Michele, and they need to grow their own supply because it is otherwise too expensive and hard to obtain.'Where is my husband supposed to get a pound of pot a month?'" --Pot Activist Denied Refugee Status http://www.cannabisnews.com/news/thread17963.shtml"A man caught in the clash of state versus federal drug laws told News 4's Brian Maass that he couldn't believe federal agents raided his home for three marijuana plants he'd grown for medicinal use.

Nord, who legally uses medical marijuana to treat numerous severe ailments – including cancer, diabetes, and chronic pain – won an appeal to reclaim three marijuana plants and two ounces of marijuana taken by the Grand, Routt and Moffat County Narcotics Enforcement Team (GRAMNET), a federal task force. GRAMNET seized Nord’s marijuana – though his possession of the drug was legal under state law – after obtaining a warrant to search his home. Judge Garrecht gave DEA officials who are holding Nord’s marijuana and materiel three weeks to return them. However, Dan Reuter, a DEA special agent and public information officer with the Denver field office, tells the Alliance that the plants are 'not alive' and, in any event, he 'can't think of a case' where seized marijuana was returned to a person who used it under any circumstances, including medicinally. Reuter also told Denver’s Rocky Mountain News that the DEA 'is not in the habit of returning illegal contraband.'" --Feds Balk After Sick Colorado Resident Wins Appeal to Have Marijuana Returned December 11, 2003Although Steve Kubby received a rare Health Canada exemption which allows him to grow 117 cannabis plants for his medicine, needing 1/2 oz. to 1 oz. per day or 1 lb. per month, Paulah Dauns, a member of the Canadian Immigration and Refugee Board, refused to grant refugee status to Steve. Even if Steve were somehow miraculously to survive the 120-day sentence for a drug conviction in Placer County undoubtedly without access to his medicine, the continued persecution of medical cannabis patients in California, Oregon, Colorado, and other states guarantees that he would not be able to grow enough cannabis to keep him alive. Health Canada allows Steve Kubby to grow 117 cannabis plants, yet the DEA will not allow Brian Maass to grow even 3 cannabis plants for his medical needs. Paula Dauns, what were you thinking?

As Don Nord's case grows, so should His plants.
Feds Balk After Sick Colorado Resident Wins Appeal to Have Marijuana Returned
December 11, 2003The Drug Enforcement Administration (DEA) is balking at a Colorado court’s order to return medical marijuana patient Dan Nord’s confiscated plants and equipment. However, Dan Reuter, a DEA special agent and public information officer with the Denver field office, tells the Alliance that the plants are "not alive" and, in any event, he "can't think of a case" where seized marijuana was returned to a person who used it under any circumstances, including medicinally. Reuter also told Denver’s Rocky Mountain News that the DEA "is not in the habit of returning illegal contraband." The DEA’s stance could set up a constitutional showdown between federal and state officials over medical marijuana laws. The court order to return the plants echoes similar decisions in Oregon and California and is the first of its kind in Colorado, where three years ago voters approved a law amending the state constitution to guarantee seriously ill patients a right to possess and use medicinal marijuana. Nord and nearly 300 other Coloradoans have signed up for the state’s Medical Marijuana Registry, run by the Colorado Department of Public Health and Environment, which requires a doctor’s letter showing medical eligibility and payment of $140 to join. Colorado, eight other states and the District of Columbia have passed referenda to allow seriously ill patients access to medical marijuana. (Congress nullified the District’s election results, preventing the will of the voters from taking effect.)

just say: "No comment" eh, Mr. U.S. Attorney?
"Jeff Dorschner, spokesman for the Colorado U.S. attorney's office, said staff will review the county judge's order for the return of the marijuana."Meanwhile, we're goig to start publicly asking U.S. Attorneys why they exempt themselves and their racketeer influenced corrupt organizations from EXISTING LAW, such as Artice III, Section 3 of the Constitution, which clearly defines treason as war against U.S. citizens, or providing aid and comfort to our enemies.Certainly no one in the mainsream press dares ask.
proof of treason

SystemGoneDown.. ....
You are absolutely right. It IS facism. I am NOT proud to be American anymore. It IS depressing. The government DOES control big media. It isn't hard for them to do. If you think about how many big conglomorates there are in big media. Two?? Three? That's the danger of consolidating into big companies such as Times Warner. However, THEY don't control the Internet. Yet. Although they ARE watching. Yes, that IS breach of privacy.

FASCISM FASCISM FASCISM, AMERICA, FASCISM
When a man who is permitted by the state to grow and use cannabis, but is overruled by the federal governement, this is FASCISM. They raided his house in total disregard to state ruling... I guess the most angering part of this is A)the frequency of cases like this where the DEA raid legal marijuana users, and B)the lack of media coverage and lack of DEA scrutiny...I no longer am gratified to be an American. My loss of pride is rock bottom. I get depressed when reading things like this. No only do the DEA and the feds in general dicated over state, but OBVIOUSLY they dictate the media because to me it makes NO SENSE that stories like this aren't disected in the media. This is a shameful event and I am still searching for a ideal way of doing something about it. Someone help me find reason.
