The council voted 6-1 Tuesday, with Councilman Kevin Dowling dissenting, to reconsider a decision it made last week that would have forced the closure of the Hayward Hempery's dispensary. The council's action was procedural. The issue is scheduled for debate at next Tuesday's council meeting.Council members said that in the pursuit of compassion for patients, they might have lost sight of some fairness issues. Hempery owner Cheryl Adams said she hadn't been notified officially about the issues debated at the Nov. 18 meeting. "Clearly, the actions we took last week were in reaction to the health and well-being of some members of our community," said Councilman Bill Ward. The council on Nov. 18 had been scheduled to consider grandfathering in The Hempery and the Local Patients Cooperative -- both on Foothill Boulevard near B Street -- as part of a compromise agreement that evolved from a city task force on medical marijuana. The dispensaries, including a third that opened recently in the same vicinity on Foothill, have been operating in violation of Hayward's zoning law. Instead, based on the facilities' reputations, the council sanctioned Local Patients Cooperative and the new Hayward Patients' Resource Center (HPRC), a revival of the former B Street Helping Hands Patients' Center. Over the course of several meetings, the council heard significant positive testimony about the HPRC and its owner, Jane Weirick, who served on the task force before coming to the rescue of the struggling B Street dispensary. The council also heard many patients advocate for three dispensaries, instead of two, in order to serve the broad range of community needs. What it hadn't heard was any testimony on behalf of The Hempery. Some council members recalled past incidents involving the facility that required police attention. So Adams, whose business just celebrated its 10th anniversary, stood before the council Tuesday to ask for reconsideration of last week's decision. She also asked to be included in any future deliberations on the issue. "If it wasn't for The Hempery, most of these other places wouldn't be there," she said. A handful of other speakers commended the council on the Nov. 18 decision and suggested that members make unannounced visits to all three downtown facilities before altering that decision. "Please stop by. Please ask the patients," said Paul Baerwald, who works at HPRC. Dowling, who made the Nov. 18 motion to sanction Local Patients Cooperative and the HPRC, said he's opposed to taking back that decision, unless it means sanctioning all three dispensaries. What to do? What to do? If I want to have a happy evening I should watch Farm Aid and if I want to get fired up I should watch C-Span.
