Medical marijuana advocates Michele and Steve Kubby are anticipating a ruling "any day now" on their historic bid to become Canada's first officially-sanctioned reefer refugees.The Kubbys fled to Canada from California three years ago, after Steve was found guilty of minor drug law violations and was told that he would not be able to use life-saving medical marijuana after his conviction.
Steve Kubby suffers from a rare form of cancer, and has long argued that marijuana is the only reason that the cancer has not killed him. A recent article in the prestigious journal "Nature" agreed with Kubby, stating that marijuana killed cancer tumors by cutting off their blood supply.The Kubbys worked for Marc Emery's Pot-TV network when they first arrive in Canada, anchoring the popular Pot-TV News. Steve Kubby also received a coveted Health Canada medical marijuana possession and grow license. He grows dozens of marijuana plants in a high-tech grow room provided to him by Canadian marijuana products company Advanced Nutrients, which conducts pharmaceutical, genetic, and plant physiology research on the crops grown by Kubby.Earlier this year, Michele Kubby acted as her own lawyer in hearings before an immigration judge. The Kubbys are seeking official refugee status. They argue that Steve would die in America if he was sent back to face incarceration or other actions relating to his earlier conviction, because authorities will not guarantee him access to medpot. They also claim they would be victims of political persecution as individuals, and as part of a persecuted minority - pot smokers - who are targets of a "genocidal" US-government war. If the Kubbys win refugee status, it will be historic, because the ruling will in effect mean that the Canadian government has acknowledged that the US is a country that routinely violates the human rights of its citizens.The refugee hearings were contentious and controversial, with government lawyers accused of lying by the Kubbys. Michele Kubby, who has no formal training as a lawyer, won plaudits from attorneys for her skillful attacks on the government's attempts to send her and her family back to the United States, and for her spirited defense of the Kubbys' right to stay in Canada.The Kubbys expected to know by October if they had won official refugee status, but events in California changed the decision date, when outgoing California Governor Gray Davis signed the aptly-named Senate Bill 420 (SB420) put forward by California legislator John Vasconcellos.The legislation purported to clear up problems associated with the state's landmark Prop. 215 medical marijuana law, written by activists like Dennis Peron and passed by voters in 1996. SB 420 set up an identity card system and a six plant legal minimum for qualified medpot patients, but Kubby says SB420 is a clever attempt to patch over problems caused by police, prosecutor and federal disdain for Prop. 215.Canadian government lawyers argued that the passage of SB 420 meant that Kubby was guaranteed the right to medpot while in jail or on probation, and that therefore his claim that he would die if sent back to face punishment in California was no longer relevant.Kubby argues that the actual language of SB420 only says that medpot patients may ask that they can use marijuana as defendants, probationers, or prisoners, but that their requests can be turned down."There are no guarantees that I would be allowed to use the medicine that saves my life," Kubby says. "Nor does SB 420 prevent the feds from coming in to attack me and other patients, as they have already done. It's a sham."The Kubby saga will soon be documented in a book about the family, called "Reefer Refugee."As the Kubbys await the immigration ruling, which is expected to be announced in the next two weeks, they are busy with cultivation projects and media work. Kubby has made an instructional interactive medpot grow CD, and is soon to release a DVD version of it.The Kubbys are also preparing to make a professional series of television shows that will be aired by Advanced Nutrients. These shows will focus on marijuana cultivation, medical marijuana, marijuana news, and politics. Kubby says his cultivation show will feature grow room footage, as well as specialty information about seed breeding, nutrients, grow room construction and design, and marijuana research."I'm blessed with a great wife, two fantastic kids, the support of Advanced Nutrients, and medical marijuana, which keeps me alive," Kubby said. Steve said there will be another show on growing very soon. If anyone sees it please post a link. I tried to watch the videos a few weeks ago but I couldn't get them to work right.

I sympathize with the Kubbys..also face the facts!
Hi my Friends;As a Canadian Medical Marijuana Exemptee myself, I truly wish from the bottom of my heart that Steve Kubby and his family wins and stays in Canada, but if Canadian Medical Marijuana Exemptees can't even win against their own government for the promised help from Health "Hell" Canada, prospects aren't too positive. There is and also the FACT that over 80% of the Canadian economy and government are owned and controlled by US interests and US government. But, I would say that since Steve and his family are in Canada, that they had the Royal treatment from our government. Contrarely to the majority of the Canadian Medical Marijuana Exemptees, Steve had his medical marijuana exemption in very little time and he also has some advantages that many other Canadian Medical Marijuana Exemptees don't have. I consider him very lucky and privileged that our government cared for him and his family so well and I truly think that our government does not want to send him to his DEATH sentance in US, but guess who orders our government? Will our government risk all kinds of sanctions just for one man? Peace, and good luck Steve!Marc

hurt, either.Look, the Canadian authorities are not as plugged in to the American news media as you might think. Nor are they as knowledgable of the predicament of MMJ patients in America as you might believe they would be after having contact with the Kubby's and *other* refugees. That goes double for the Canadian public.The enormous pressure the 800 TON gorilla that is the United States Federal Guv'mint can apply against Canada is something that many Canadians silently, hotly resent, and rightly so. In truth, much of what they hear is from US 'offical' sources. But a concerted letter writing campaign on the part of American citizens decrying our Feds seeming obsessive efforts to corral and kill Steve Kubby and the others who have fled for their lives could provide the much needed voice of reason to counterbalance Uncles' 'Mighty Wurlitzer' propaganda machine constantly blatting in Canadian ears. Just mention what was done with Peter McWilliams, and point out the treatment Rene Boje experienced at her arrest, and the point becomes not only crystal clear but razor sharp that Uncle means to *destroy* the refugees as an object lesson. Everything that has happened since that genetically altered monkey escaped from the National Zoo, killed George Bush the night of the (s)election and took his place is enough evidence that the Unites States justice system no longer functions as Constitutionally mandated. The checks and balances that we were so proud of, have, to use Grace Slick's terminology, 'fallen sloppy dead'. There's NOTHING to prevent unlawful deaths, as have happened in the cases of Esequiel Hernandez, Ismael Mena, Alberto Sepulveda and sooooo many others. Justice in America has become as Cicero complained 2,000 years ago: a 'whore that smiles at the man with the biggest purse.'To send the Kubbys and all other MMJ refugees back to the certain death that awaits them would be beneath the dignity of a country that prides itself on being America's more upright neighbor.I don't know who to write to, but I am sure our Northern brothers and sisters can tell us...

After having served 2 years for growing, and countless other possession related crap prior to that, I realized I did at least 10 years. I compare this to in house arrest as I was always looking over my shoulder to avoid police as well as thieves.Patriot was a term that was originally associated with individual freedoms. Now it's conotation is more racist than ever. It's generally defined by going with the flow of the mindless flagwaivers; whose idea of freedom is cheap beer, a barbeque, and pro-sports. No offence to those of you who like that crap (as long as it's not your definition for freedom that is). If writing letters to senators, editors, and message boards is going to help raise awareness of the injustices caused by the US government, then SO BE IT!!!! (Perhaps it'll give me arthritis. My Feelings About The Kubbys
I hope the Kubby's will be allowed to stay in Canada. It wouldn't be good for them back here. So much has changed since they went to Canada. I hope that Canada remembers what it is loved for the most and it is accepting people who need a country because their own country wants harm to come to them. Please be wise Canada. Our loss of the Kubbys is your countries gain.

What does the mayor of Toronto think?
The city of Toronto elected a left leaning mayor who said the days of corruption are over. Now when one in seven Canadians live in Toronto, what the mayor thinks has to be a big deal.
