Dear Supervisors,It's been exactly five months since the January 19th raid on the Kubby Family by Placer County deputies. Public outrage over this raid has resulted in over 100 news stories and editorials condemning our illegal arrest.
As you well know, thousands of angry e-mails and faxes flooded the Placer County offices of the Sheriff and District Attorney, while the Tahoe World reported a record number of letters to the editor. As you well know, thousands of angry e-mails and faxes flooded the Placer County offices of the Sheriff and District Attorney, while the Tahoe World reported a record number of letters to the editor.The raid began early in the morning when twenty SWAT members from the North Tahoe Narcotics Task Force, armed with laser guided automatic weapons, body armor and a battering ram, blocked off our street and raided our home, in open violation of Prop. 215, a law we played a key role in passing.Although we presented our medical documentation, we were arrested and nearly all of our assets were seized. As a result, we were forced out of our home, out of our business, out of Placer County, and into bankruptcy.It not just us either. Dozens of legal medical marijuana patients have been treated as bad or worse. Dr. Michael Baldwin, who used to give free dental care on weekends to Placer County residents, has been driven out of business by a SWAT raid that recently resulted in a hung jury. Mrs. Baldwin was reportedly struck by an officer during their raid. The Orange County Register called the our arrest an "Outrage in Law," while the OC Weekly called it "The Drug Warriors' Worst Mistake." The Los Angeles Times wrote an extensive article about the Kubby raid which appeared on page 3, while the San Diego Union ran the Kubby story on their front page.The popular TV show, "Inside Edition" has completed a story about us, which is scheduled to air nationwide on July 2, 1999.Obviously, many people are concerned about what is happening to sick and dying people in Placer County. That concern will only increase until something is done to end what amounts to a criminal conspiracy amongst rogue officials who refuse to obey the law.As County Supervisors, it is your responsibility to protect the sick and dying members of your community. Instead the sick and dying are being persecuted in record numbers and a law which was passed by 3.5 million Californians is being openly flaunted. Dozens of documented medical marijuana patients have been raided, arrested, humiliated, looted and destroyed, by YOUR deputies, all in a vain attempt to uphold a corrupt and failing drug policy.In all cases, your Placer County deputies are seizing 100% of all medical marijuana in possession of patients, in open violation of 11362.5 H&S which EXEMPTS properly documented medical marijuana patients from the laws regarding possession and cultivation.What part of "EXEMPT" do Placer County law enforcement officials not understand?I urge you to treat this matter with the utmost urgency.
