Halifax, Nova Scotia -- A British Columbia lawyer plans to seek an emergency injunction from a Vancouver court allowing his client, Michael Patriquen, to use marijuana in prison.Patriquen, 49 and jailed in Westmorland Institution in New Brunswick, has a Health Canada exemption allowing him to use marijuana to treat chronic pain resulting from a 1999 car accident. More conventional treatments have not helped him.
Corrections Services Canada, however, has prohibited Patriquen access to the drug. Prisoner Awaits Federal Court Ruling on Bid for Medical Pot Cookies

VANCOUVER (CP) -- A Federal Court judge in Vancouver has reserved decision on allowing a Nova Scotia man to eat marijuana cookies while in prison. Michael Patriquen wants to eat the cookies to treat chronic pain while he serves time in a New Brunswick prison for marijuana trafficking. His case is being heard in Vancouver because that's where his lawyer, a specialist in marijuana law, practises.. Lawyer John Conroy told the court his clients' rights are being violated under the charter because he isn't allowed access to his pain medication. "They're forcing him to get hooked on harder drugs," he said in an interview. Conroy said Patriquen has lost 50 pounds because the pain in his shoulders and neck from a car accident is so severe he's nauseous. While in prison, he has been offered a strong pain killer but Conroy said his client is afraid to become addicted to them.
