California Courts are returning medical marijuana to patients and processing damage claims against police. – Sonoma DA ignores state laws against commercial cultivation and sales of medical cannabis.
On November 5th, 1998 the California Supreme Court upheld Mendocino County patient Christopher Brown’s petition demanding the return of his medical marijuana. The Court effectively ruled that federal law does not supercede Proposition 215 meaning that California cops can’t enforce federal pot laws.Medical marijuana patients are fully protected by California law and judges throughout the state are ordering marijuana plants, dried flowers, joints, scales, grow lights, and all sorts of interesting stuff illegally seized by police returned to their rightful owners.Now State Courts are hearing big dollar civil lawsuits from patients whose plants and other property were damaged in police custody. Robert DeArkland in Sacramento suffers from prostate cancer and arthritis. He is seeking $11 million dollars in wrongful damages after local police seized his 13 marijuana plants, $420 in cash, and a scale.Dean Jones in Simi Valley is a diabetic who uses marijuana because he suffers from migraine headaches, nerve damage, and high blood pressure. His eleven confiscated cannabis plants were returned to him desiccated when police stored them in the evidence room and failed to water them daily. Judge Glen Reiser allowed Jones to seek compensation against the department for being held for 14 hours before being released. He also claims embarrassment and that the incident frightened his ailing, 82-year-old wife. He said he will leave the amount of compensation up to the jury. In Sonoma County commercial manufacturers are producing marijuana for sale. District Attorney Mike Mullins recently declined to press charges against CHAMP, a store that grows marijuana in Sonoma to sell at 194 Church St. in San Francisco. CHAMP’s Executive Director, Ken Hayes was caught ‘green handed’ last month operating five grow-rooms producing 500 plants, with ten pounds dried, ready for sale. No charges have been filed.
