Vancouver - The solicitor general's critic for the Canadian Alliance party says the federal government needs a national drug policy, now more than ever. Langley-Abbotsford Alliance MP Randy White says Canada has no clear direction on possession of small amounts of marijuana. He also says Prime Minister Jean Chretien shouldn't talk about decriminalization without a clear national policy, plus agreement from the provinces.
"You can't just blurt out that, 'Well, here's the level that's decriminalized,' because it does give a green light to some extent on this pot issue." White made the comments as three men – two of them from B.C. – get set to take their constitutional challenge of Canada's drug laws to the Supreme Court of Canada. They hope their case, which begins on Tuesday, will lead to a complete decriminalization of marijuana possession. In 1993, Randy Caine was convicted of possession after being arrested with a half-smoked joint in White Rock. He was later discharged. But Caine has not let the matter go. The court is also hearing the arguments of two other men involved in the sale of seeds and pot. All three cases were supposed to be heard in December. But at the time Justice Minister Martin Cauchon hinted marijuana would be decriminalized in a matter of months, so the case was set aside. This Republican in Maple Leaf clothing wants the provinces to agree before the federal government takes action. What is this, a Constitutional Amendment? Cannabis was never declared Unconstitutional is the first place. Just be glad that Randy While and the Alliance Prohibition-Boosters are not the federal government of Canada. The courts are on the leading edge of cannabis law reform. Let us hope that the Supreme Court of Canada continues in the fine tradition of Canadian courts and judges these cases on rational merit. ego transcendence follows ego destruction, and suddenly there is no question.
