  Medical Pot Need Wouldn't Protect Him in Oregon

Vancouver -- An Oregon official overseeing the state's medical marijuana program has told a refugee hearing that her program couldn't protect a pot user from U.S. drug laws. Mary Leverette testified by phone Wednesday for Immigration Canada in a refugee claim by Californian Steve Kubby. Leverette said if a medical user is found with more than one ounce of marijuana, he or she could be arrested and charged. Kubby, 56, says he needs far more than that to treat his rare adrenal cancer. 
One ounce would last him two days, Kubby claims. Without the pot Kubby says he could be facing a heart attack, stroke or kidney failure within 24 hours. Kubby claims he's being persecuted in the United States because of his medical pot use and is seeking permission to remain in Canada as a refugee. A parade of witnesses on his behalf testified that despite a California law sanctioning medical use of marijuana, pot users still face arrest and imprisonment because federal authorities don't recognize the state law and drug enforcement officers ignore it. Kubby has Health Canada permission to grow up to 59 marijuana plants. The hearing was to wrap up Thursday, with a decision on Kubby's claim expected by fall. Michele Kubby pointed out to the hearing that one ounce would last Mr. Kubby only two days and without the pot her husband would be facing a heart attack, stroke or kidney failure within 24 hours.The final witness for Canada Immigration, Dan Sattenberg, the Chief of Staff for the Seattle District Attorney's Office, testified that their office made every attempt to honor the rights of medical marijuana patients. However, on cross, he admitted that patients are limited to an affirmative defense in Washington State and a 60-day supply. Mr. Sattenberg also admitted that no definition currently exists for how much a 60-day supply can allow and that anyone caught with the amount used by Mr. Kubby would probably be arrested and charged.When asked if Mr. Kubby would be subject to arrest by the DEA, Mr. Sattenberg revealed that in Washington State, the DEA has told him that they will not go after cases involving less than 500 plants or 50 pounds. Mrs. Kubby followed up this surprising admission by asking Mr. Sattenberg why the DEA was raiding and chopping down as few as 17 plants in Oregon, but ignoring under 500 plants in Washington. Mr. Sattenberg replied that those two states have different administrators who have the discretion to enforce the law as they deem best.A parade of witnesses, including a sitting judge and a co-author of Prop. 215 all spoke out on Mr. Kubby's behalf, testifying that despite a California law sanctioning medical use of marijuana, pot users still face arrest and imprisonment because federal authorities don't recognize the state law and state drug enforcement officers ignore it.Only one American has ever succeeded in winning refugee protection and that decision was later overturned on appeal.

Can someone explain something, please?
We Americans ostensibly have a court system in which facts are supposed to be presented to the jury in order for them to make an educated decision.Yet, in every MMJ case I know of, the pertinent facts are never made available to the jury.But in Canada, their courts are willing to take depositions OVER THE BLOODY PHONE, from foreigners, in order to ascertain the truth.That says something most Americans don't want to hear: if you expect a dogged commitment to justice dispensed from the American system of jurisprudence, you should stop drinking the rotgut, it's making you delusional.

Steve Kubby, a cancer survivor, par excellence, is informing the US and Canadian people of the cruel folly of current medical cannabis laws. If the restrictions applied in even liberal states like Oregon would not have allowed him to live so long, then how many of their own residents have already died over the last 33 years of delay, waffle, and water-down.
