Vancouver - An American man who says he was persecuted in the U.S. for using medical marijuana began presenting his case at a refugee hearing in Vancouver Wednesday. Steve Kubby is the founder of the American Medical Marijuana Association and has been living in British Columbia for more than a year. Kubby suffers from adrenal cancer and says he has to smoke marijuana several times a day to prevent blood pressure spikes, rapid heart beat and other problems brought on by producing too much adrenaline.
Kubby, who was representing himself, told the hearing that if he didn't toke up every hour, he could die. Regular toke breaks Hearing officials granted him regular smoke breaks during the session. Police raided Kubby's home in Lake Tahoe, Calif., in January 1999 and laid charges after seizing hundreds of marijuana plants. A jury found Kubby not guilty on those charges, but he fled to B.C. to avoid jail time on a lesser conviction. After Canadian immigration officials attempted to deport Kubby, he filed for refugee status. Lawyer Gordon Starr, who is representing Canada's Citizenship and Immigration Department, dismissed Kubby's claim that he was being persecuted. Starr said Kubby had a fair trial in the U.S. and was convicted of possessing peyote and a hallucinogenic mushroom stem, not any marijuana offence. While medical marijuana is legal in California, Kubby told the hearing that there is a conspiracy to undermine the law. His star witness, former journalist Patrick McCartney, has written a book about the fight between federal and state governments over medical marijuana. McCartney told the hearing that documents show federal and state law enforcement officials have regularly tried to undermine the law. Kubby's hearing is expected to last eight days. Correction to comment1
Federal prohibition became effective October 1, 1937, so that it is now 65 years and 5 months old. And of course, we can now add one more day.

Picked this up over at...
...www.marijuananews.com. "The Canadian government’s eight day refugee board hearings for Steve Kubby and his family began today with a crucial concession from the Canadian government.""In his brief opening statement, the representative of the Immigration Minister did not assert the absolute doctrine that there could be no refugees from DEAland, as has previously been argued by the government and a prohibitionist local Member of Parliament, Randy White."For Richard Cowan's analysis of why this is a very important (and positive) development in the Kubby case, as well as an overview of Mr. McCartney's work, see the link below.

Stone him
Kubby, who was representing himself, told the hearing that if he didn't toke up every hour, he could die. Hearing officials granted him regular smoke breaks during the session. Don't they know smoking that stuff will turn him into a mad assassin? He might turn into a bat and then where would those dumb Canucks be? We have 65 years, 4 months, and 6 days of accumulated knowledge that absolutely proves America is right. Yeah, right, as in The Great Right Dope. The right is wrong and the left is right. And that is no doublespeak.
