Angry that a medical marijuana activist blames a fellow judge for disrupting a major pot trial in Sacramento federal court, a magistrate judge sent the activist to prison for three months Thursday.Jeff Jones, a nationally known champion of medical marijuana, was found guilty at a non-jury trial in December of attempting to influence the trial of fellow medical pot advocate Bryan Epis.
U.S. Magistrate Judge Peter A. Nowinski ordered Jones, 38, to pay restitution of $3,925, the cost of bringing the first prospective jurors to court for the Epis trial. All 42 were disqualified and a second panel convened by U.S. District Judge Frank C. Damrell Jr., who was convinced that material handed out by Jones and other protesters to members of the first group as they walked toward the courthouse contaminated the entire pool.Jones' attorney, Michael Bigelow, set off Nowinski and caused him to reconsider his inclination to impose straight probation by arguing that it was not necessary to dismiss the jury pool.Damrell acted out of "pique, rather than reason," Bigelow wrote in objecting to nearly $4,000 in restitution.Snipped: Complete Article: http://www.freedomtoexhale.com/jeff.htm Source: Sacramento Bee (CA)Author: Denny Walsh -- Bee Staff WriterPublished: Friday, February 28, 2003Copyright: 2003 The Sacramento BeeContact: opinion sacbee.comWebsite: http://www.sacbee.com/Related Articles & Web Sites:OCBChttp://www.rxcbc.org/Bryan Epis Protest Pictures & Articles http://freedomtoexhale.com/protestpics.htmPot Club Director Gets 3-Month Prison Termhttp://cannabisnews.com/news/thread15602.shtmlPot Backer Convicted of Tainting Juryhttp://cannabisnews.com/news/thread15000.shtmlFirst Federal Medical Marijuana Conviction http://cannabisnews.com/news/thread13398.shtml

I know Jeff, he is an outstanding human being, anyone whom thinks he belongs behind bars needs to see a doctor. Period.

Re- Jeff Jones' Hunger Strike.
Prison hunger strikes, like the Buddhist self-immolations during the Viet Nam War, are a time-honored tradition. They may not make sense to most of us, but they make martyrs to a cause. If governments were more compassionate, such extreme techniques would not be necessary. Ask Nelson Mandela.ego destruction or ego transcendence, that is the question.

Reflecting, remembering, and thinking
Thomas Paine is most famous for "Common Sense" calling for the separation of the colonies from England. He was a Diest that had influence over everyone including Washington and more importantly Jefferson. We still have his writing that can be seen at thomaspaine.org and we have current writings that appear at that website for people that recognize the importance of Paine's work.The Crisis Papers- http://www.thomaspaine.org/archive/crisisindex.html - contain in the first tract what is probably his most notable sentence. The first paragraph of "The Crisis#1" reads- THESE are the times that try men's souls. The summer soldier and the sunshine patriot will, in this crisis, shrink from the service of their country; but he that stands it now, deserves the love and thanks of man and woman. Tyranny, like hell, is not easily conquered; yet we have this consolation with us, that the harder the conflict, the more glorious the triumph. What we obtain too cheap, we esteem too lightly: it is dearness only that gives every thing its value. Heaven knows how to put a proper price upon its goods; and it would be strange indeed if so celestial an article as FREEDOM should not be highly rated. Britain, with an army to enforce her tyranny, has declared that she has a right (not only to TAX) but "to BIND us in ALL CASES WHATSOEVER," and if being bound in that manner, is not slavery, then is there not such a thing as slavery upon earth. Even the expression is impious; for so unlimited a power can belong only to God.

If Jeff feels that strongly about a hunger strike then he should do it. I guess I feel that hunger strikes don't help that much. People who are fasting get weak and become passive and it won't bother his jailers if he does. Meeting others who are in jail and finding out why they are there could be beneficial. Susan McDougal said that when she went to prison she was going to isolate herself and read books. Instead she had people coming up to her and telling her why they were there. They would gather together and had a game I think she called it. It was a game that they called why I am in jail. This is not exact but I hope I'm making the point right. She is now an activist for prisoners. Jeff will be respected and can do a lot of good but he wouldn't be able to do good if he gets run down and sick. It's his life though and I respect what he is willing to do but I would try another way but that's me.

Some are trying to talk JJ out of it.
But he is sticking to his guns as of late last night.I am ambivalent. What can we do but throw our bodies
on the hideous Ashcroft nightmare? Perhaps Jeff Jones has
part of an answer.

I wish he wouldn't go on a hunger strike. He will suffer and you're right they will force him to consume glucose or something if he gets too weak. If he would do what Jack Herer did and write a book that would be good.

Jeff Jones vows hunger strike
Jeff Jones has vowed a hunger strike while in prison, to draw attention to the cause of medical cannabis patients who die prematurely without the healing balm of the sacred cannabis plant, a plant which has the most ridiculous man in the history of the world, John Ashcroft, on a holy (with the full backing of Jesus, he believes) crusade against any and all users of this plant.The Ashcroftian state will naturally force-feed him glucose to keep him alive.

Here's some research....
This sucks about Jeff Jones as he difinately is one of the Good Guy's and someone whom I have always respected. There is nothing the Nazi's won't do to finish us off, how much more do people have to see to understand where this is all heading? Four of those arrested by feds in BongBust were patients of ours so I KNOW they were medical...and helping to reduce harm in our patients by giving them PHAT discounts so they could smoke in cleanest and purest form. What's this world coming to, have we forsaken God?Here's a few studies on Cannabis and Lung function, I will have our entire research page indexed by this weekend if it kills me as this is why we are going to keep this page up until hell freezes or Cannabis is legal for all who need it. btw....
It is shocking to see judges routinely send people to jail for speaking out politically. I was very disturbed to see several people sentenced to 3 months in jail for protesting the Vieques bombing range in Puerto Rico last year.Sadly, now that the Soviet Union is gone, I guess the ruling elite think that we can gradually morph into what they were. The dumbed-down masses won't notice, as they are too busy being seduced by the culture of consumerism that is brainwashed into us from infancy.

Here's is my personal knowledge on your question:1) Tars from burning tobacco clog up the lungs. Nicotine has the action of paralyzing the little hairlike cilia that sweep bronchial passages clean, impeding the lungs' natural cleansing process2) Cannabis smoke also clogs the lungs with tars. However, the active ingredients act as an expectorant, enhancing the cleansing process - the opposite of nicotine. Further, the cannabinoids act as a bronchodilator, opening the bronchial passages up. Part of this is explained by the fact that cannabis is a smooth muscle relaxant, so the muscles surrounding the bronchial tubes loosen up, widening the passages.And recent studies have shown than the cannabinoids act as a suppressor of cancer at the cellular level in the lungs, possibly explaining why no one's ever gotten lung cancer from cannabis smoking alone.Of couse, the best thing to do is use a vaporizer - then you get all the beneficial action of the cannabinoids while almost eliminating the negative effects of smoking by-products! Here are the studies I usually use to make the case for using cannabis for asthma. Luckily, I was able to this research before succumbing to the schizophrenia and reduced IQ from cannabis use!1) Effects of smoked marijuana in experimentally induced asthma.
Tashkin DP, Shapiro BJ, Lee YE, Harper CE.2) Bronchodilator effect of delta1-tetrahydrocannabinol administered by aerosol of asthmatic patients
SJ Williams, JP Hartley and JD Graham 3) Single-Dose Effect of Marihuana Smoke
L Vachon, M. Fitzgerald, N. Solliday, I. Gould, E. GaenslerThere are 2 good studies on the anti-cancer effect of cannabis in the lungs, unfortunately I don't have them handy. You could find them on pubmed.

The Smokey Backroom at FreeRepublic
From time to time I read FreeRepublic because of the people concerned about the Constitution that post there. This thread- http://www.freerepublic.com/focus/news/853946/posts - starts with the posting- Vanity: Is protecting Constitution no longer goal of Freerepublic.com?Posted on 02/28/2003 10:03 AM PST by libertyladyI have recently noticed that the home page of Free Republic no longer has the icon at the top which states that one of the goals of this website is protecting our freedom and our Constitution. Can anyone help me shed some light on this? I would hope that this is a temporary change and not an official declaration made by the staff of this website. With the lack of articles and lack of alarm posted on this website about the Draconian Patriot 1 and Patriot Act 2 I have began to wonder about whether this site really does support the Constitution.Well the WOD is one serious stretch of the Constitution. I guess it shreads better once it is stretched. The last few times I have scanned the Freepers there is almost nothing on the WOD and is evident in post#2 in the above thread.If you havn't noticed, the moderators have been moving anti-"War on Drugs" postings to the Smokey Backroom almost immediately. That's unfortunate, as JimRob himself once posted a lengthy comment about the unconstitutionality of the federal component of the WOD. Sometimes I wonder if FR is beginning to morph from a truly conservative website to a wholly-owned subsidiary of the RNC.The next posting just says "Yes." Anyway, it is almost like corporate America pays people to spout the party line at FreeRepublic. If you don't believe in creationism and the evilness of homosexuality that should get you stoned or deported, or don't think the Great Dickhead is wonderful, you get bashed at FreeRepublic, They employ a lot of "Shoot the messenger in their arguements.Anyway the link to the Smokey Backroom is http://www.freerepublic.com/focus/backroom/browse

And on a sidenote:Mayor defends Pocatello 'head shop' busts, arrestsBy John O'Connell - Journal WriterPOCATELLO - Toni Reisner wasn't happy when her son Damon Bosquez took a job at Smokey's Den about five years ago, but she thought it was honest work.She believed her son and other workers who sold glass pipes and smoking accessories at a so-called "head shop" protected themselves legally by posting signs informing customers all products were intended only for tobacco use.Monday morning, police arrested her son and five other employees and owners of local stores on felony charges of selling drug paraphernalia.In Pocatello, police and federal officials confiscated truckloads of alleged paraphernalia from Smokey's Den, 145 S. Third Ave., Pegasus Book Store, 246 W. Center St., and Twenty after Four 218 N. Main St."I want to know how these businesses are licensed in Pocatello, but yet it's illegal," Reisner said. "My kid's never been in trouble in his life."Mayor Roger Chase said the warrants were issued by the federal government, and the city's role was to assist and observe. He said the City Council never discussed the topic."This was a federal indictment, and the law they were citing them on was a federal law and not city or state laws," Chase said.------------------------snip---------------------------http://www.journalnet.com/articles/2003/02/28/news/local/news04.txt

Just a Question
I am looking for information on Cannabis smoke and the lungs. I had read at one time that one of the qualities of cannabis was that it actually expanded the pathways in your lungs instead of constricting and blocking them like smoking tobacco causes. Can anyone point me in the right direction?Thank you!!!

DEAwatcjh links
Everyday http://members.aol.com/deawatch/daily.htm puts up links to news relating to the DEA interest. Today, one link spoke of 40 of the 258 firt-time offenders being released from Michigan prisons on March 6- http://www.detnews.com/2003/metro/0302/27/d12-95435.htmThe governor of South Dakota gave the one true message from the prohibitionists standpoint here- http://www.aberdeennews.com/mld/aberdeennews/news/5274949.htm Anything else bromgs on the dreaded mixed message chant."The message on drugs . . . needs to be clear, very clear. It needs to be that drugs are illegal, drugs are dangerous, and in the governor's words, 'are out of bounds when it comes to extracurricular activities.' "There is one link to an article addressing 60 employees of one Eureka bong terrorist store without paychecks because the DEA seized them and threw everyone out of work along with the health insurance of an expecting mother. One of the three store owner asked how he is supposed to hire a lawyer when the DEA took all his money. http://www.times-standard.com/Stories/0,1413,127%257E2896%257E1205947,00.htmlFederal prohibition started October 1, 1937. 65 years times 365 days equals 23,725. Add 16 days for leapyear and 92 for Oct, Nov, and Dec. and 59 for 2003 and we have had prohibition for 23,902 days.Jack Herer talks about man-years served because of prohibition. I think more in terms of the McDonald's sign that says x billions served. How many days have been served in American jails for cannabis prohibition going back to Utah's prohibition. Carl Sagan would say billions and billions.

Jury Rights
The interview with the jury foreman in the federal marijuana cultivation case against Ed Rosenthal shows the jury was not apprised of their authority to veto a criminal prosecution. Unfortunately, the trial judges are so hostile towards jury nullification that they lie to the jury, by instructing the jury that the jury MUST follow the judge's instructions of law, even if the jury disagrees with the law. Moreover, the trial judge prevents defense counsel from informing the jury of their veto power, during summation. A fully informed jury is the "conscience of the community." Obviously, the judges would prefer we only have the conscience of the government. If it was not for jury nullification, we would not have our Federal Constitutional Amendments:
[1] First Amendment;
[2] Women's Equal Rights Amendment;
[3] Repeal of Fugitive Slave Laws;
[4] Repeal of Alcohol Prohibition.
Yet, government schools do not teach this. www.johntaylorgatto.com. Freemasons have had a deleterious effect upon American freedoms. www.texemarrs.com; www.freeworldalliance.org; www.tarpley.net.
