OTTAWA  A B.C. man learned yesterday that if it can be smoked, better not toss it out with the trash.
The Supreme Court refused to hear the case of John Krist, convicted of possession of marijuana for the purpose of trafficking because of his garbage.The Mounties busted their man after grabbing a couple of garbage bags on the road outside Krist's house in the Fraser Valley town of Pitt Meadows. Inside, they found marijuana plants and material allegedly used to grow pot.The find was enough to convince a judge to sign a warrant to search his house and van, where ample evidence was scooped up to nail a conviction.Krist went to the high court to argue that police violated his constitutional rights because they did not have a warrant when they hauled his garbage away.The Supreme Court did not give reasons for not hearing the appeal, but the B.C. Court of Appeal had previously ruled that police don't need a warrant to search trash that has been abandoned.

It Figures!
Here is a perfect example why so many people have lost faith in the Constitution. It works when the government can gain from it. When they can gain by making it invalid, they do so. Just try to prove that a cop did anything illegal if you are without witnesses. Their word is considered legal evidence, even if it is a lie. You are not going to prove it. You have rights when the government wants you to have.
