Medical marijuana activists gathered outside San Diego City Hall Wednesday to ask municipal leaders for help in a fight with federal authorities. Steve McWilliams of Shelter from the Storm said his group operates under state guidelines for "growing medicine," and was under the impression that federal authorities wouldn't take action for an operation of fewer than 100 plants.
"In spite of all of our precautions ... we were still raided and had our plants destroyed," said McWilliams, holding a pipe filled with marijuana at a rally in the San Diego Concourse outside City Hall. Members of a regional drug enforcement task force served a federal warrant Wednesday. They searched Williams' Normal Heights marijuana garden and seized more than two dozen plants and 10 pounds of loose marijuana. As activists chanted, "Go away, DEA!" at the San Diego Concourse this afternoon, several San Diego police officers stood by, making sure the demonstration went smoothly. "We're not taking any enforcement stance today," said Sgt. Todd Griffin. Proposition 215, passed in 1996, allows patients with permission from a doctor to use marijuana for medical conditions. But the state law has been problematic, as federal law makes no exception for medical uses. McWilliams said city officials should "stand up as our representatives" for his group's activities. McWilliams said the city's efforts, including a task force working on guidelines for medical marijuana use, provide "unrealistic assurances." McWilliams' group gave pot away to those with a doctor's note last week outside City Hall. He asserted that Mayor Dick Murphy called for the federal raid in response to the drug giveaway, though he acknowledged he has "no proof." "No one in the mayor's office has had any contact with the DEA regarding Mr. McWilliams," Murphy stated through his press secretary. The activists also spoke out against the city at a meeting of the City Council's Public Safety and Neighborhood Services Committee, and planned to move their protest to the Federal Building. Councilwoman Toni Atkins said it was important for the activists to let federal officials know of their frustrations. She said the city isn't getting any help from other jurisdictions, including the county and federal governments. Medical marijuana advocates say cannabis can help relieve pain and other symptoms for patients with AIDS, cancer and other conditions. On Oct. 16, the PSNS Committee is expected to discuss an identification card program and other medical marijuana-related guidelines the task force recommended. The ID card would identify marijuana users in compliance with Proposition 215, in case they come in contact with San Diego police.
