Vietnam Veteran B.E. Smith, who uses medical marijuana to treat his post-traumatic stress disorder, was found guilty today in federal court. He now faces a 10-year mandatory-minimum sentence for growing less than 50 plants. The government did not permit him to use any evidence of his medical condition as a defense.
Smith, a California resident, had the permission of his local sheriff to grow medical marijuana. This is the first successful federal challenge to Proposition 215, enacted in 1996 by 56.4 percent of the voters."It is a sad day for state's rights, medical freedom, andcompassion," said Peter McWilliams, and AIDS-cancer patient who faces similar federal charged."My heart goes out to B.E. and his family."This is so terribly wrong!Thanks Cryote for the article!

Hello Dr. Ganj!It really has me down too! Yesterday's news went from happy to down right depressing. I hope the ACLU really gets behind the issue. We sure need help. America, what does she stand for anymore?I still have hope but with news like this it sure gets hard to see the rainbow in the middle of the storm!Peace, FoM!

Why couldn't the jury smell a rat?We can NEVER trust judges' instructions. It figures this happened in Sacramento. Don't go there, it's a backroads hick dustbowl, with troglodytes as judges, and mindless cretins as jurors.Read this:     Jury Nullification—YOU [the juror] HAVE THE INALIENABLE POWER TO REFUSE TO CONVICT, regardless of the evidence presented, regardless of the law as written, and regardless of the judge and the judge’s instructions. IF YOUR CONSCIENCE, your SENSE OF JUSTICE, OR your OPINION of the law DOES NOT PERMIT YOU TO CONVICT someone, YOU DO NOT HAVE TO!
