WASHINGTON Police do not need a warrant to seize someone's car from a public place under laws requiring forfeiture of property linked to crime, the Supreme Court said Monday. 
The 7-2 ruling reinstated a Florida man's drug conviction based on the crack cocaine police found in his car after seizing it without a warrant. Police said the man's car was subject to forfeiture because it had been used to deliver drugs several months earlier. The case involves seizures made under a Florida law that allows forfeiture of property used in committing drug crimes. A similar federal law provides for forfeiture of vehicles used in transporting illegal drugs. Click the above link to read the whole article!

Seizure of Vehicle in Lake County Florida
To whom:Recently a vehicle was seized from our son, he was caught trying to take tires off a truck at a car lot. He is a juvenile, and no stolen parts were ever on the truck,. The vehicle was not ever on the premises of the scene of the crime.  There was no evidence that he intended to transport any stolen parts.  Nevertheless, police siezed his vehicle, and offered to sell it back to us for $850.00. We filed for adversarial hearing, and spoke to a lawyer, the lwyer said that for $1000.00 he could probably get the vehicle back for us. Let's see HMMMMMMMM....... buy it back for $850.00 with no adjudication, no proof that they could even take it, or $1000.00 for an attorney to try to get it back.....Of course we bought it back, with the police never having to prove they had right to take it in the first place. I say this is legalized extortion. This is wrong of the police to have this much power and it is all about money!!!! I made the check out to the Police Department Building Fund.   I also wrote to the ACLU.  If Everyday people dont get involved in protecting our Civil Rights, WHO WILL???????? SPEAK OUT AGAINST INFRINGEMENT OF YOUR CIVIL RIGHTS!!!!!!! IF YOU DON'T, NO ONE ELSE WILL!!!!!!

Wake Up Carlson!
Read your Constitution before you start laughing so hard. There is such a thing as "due process" and protection against unreasonable (hence, illegal) seach and seizure not to mention protection from excessive fines. I find it a sad state of affairs that someone laughs at another's rights being violated. Get a life!
