VANCOUVER -- In a hearing Tuesday before the B.C. Supreme Court, a visiting judge refused to hear an appeal by Steve Kubby and Brian Carlisle for permanent or even temporary emergency exemptions to use marijuana legally. Without offering any explanation and without Kubby or Carlisle even present in court, the judge abruptly adjourned the case to the 19th of August. This second adjournment comes after already having the matter adjourned from July 15th to August 6th.
The emotionally charged courtroom was filled with supporters who were stunned by the turn of events. Suddenly, Michele Kubby cried out to the judge; "You're endangering my husband's life!""Seeing the Supreme Court acting in such a cowardly manner had a profound impact on me," said Michele Kubby. "Our family is facing a crisis and all the courts have done is waste our precious time and limited resources. Steve's health is going down hill and we need to take action now to save him."The Kubbys are applying to Health Canada and have set a deadline of August 19th for Health Canada to provide a full exemption. According to Michele Kubby they are providing all the information required for a Category 1, terminally ill exemption, to cultivate medical cannabis, including a letter of approval from a top ranking Canadian cancer specialist."By the end of the 19th we will have given Health Canada and the B.C. Supreme Court every opportunity to do the right thing," explained Michele Kubby. "After that we're through asking anyone's permission, or jumping through anymore hoops -- we're just going to grow it.""We've asked our good friend Marc Emery if he can provide a safe space for us to grow our medicine and he's offered to help," said Steve Kubby.
