Lawyer Argues to Have Marijuana Case Reopened!

TORONTO The lawyer for an AIDs sufferer who smokes marijuana to control the side effects of medication asked a judge to reopen his client's case Thursday and exempt him from prosecution. Alan Young asked that Jim Wakeford not be prosecuted until the federal government decides on a policy regarding the medicinal use of marijuana.
"I would ask the court to grant an interim constitutional exemption so he doesn't have to be treated like a criminal," said Young. Wakeford originally filed a suit against the federal government in February 1998 for safe and affordable marijuana for his symptoms. But last September, Justice Harry LaForme dismissed Wakeford's request to be allowed to smoke pot because he said a federal process existed through which Wakeford could get an exemption. He said at the time that it's up to Parliament to change the laws, not the courts. Wakeford has been smoking marijuana for several years to combat the violent nausea and appetite loss caused by the AIDS drugs he takes.
